In recent years,the rapid development of China's economy has promoted the transformation of society.The public services which are single and lacking in specialty can no longer be recognized by the public.The public expect to enjoy better,more effective and more professional public services.Therefore,it is wise for the government to make social forces become public service providers and make some public services be provided by social forces.At the critical moment when a large number of social issues have emerged in social transition,social organizations have advantages over other social forces because of their characters of being close to the public and having professional skills.However,in reality,as more and more public services are open to the society,the corresponding legal regulations are insufficient.Therefore,some public services provided by many social organizations are often criticized.This not only results in the loss of a large amount of public resources,but also leads to an ever-increasing contradiction between the public and social organizations.This is not conducive to the construction of service-oriented government and harmonious society.In recent years,although our government has taken a series of measures to solve the problems of social organizations' providing public services and has made success in many places,the quality of public services provided by social organizations is still far from the public's expectations.In addition,in our country,the way of social organizations as one of the public service providers is new,so whether it is the government who is the public service buyer,social organizations who are public service providers or the public who are public service receivers,all of them have a variety of practical problems to be solved in the ways of purchase,provision or enjoyment of public services.Therefore,the author takes the practical problems which exist government's purchasing public services form social organizations as the starting point,analyzes the Chinese government's legal countermeasures against the actual dilemma,and tries to put forward the problems in the legal countermeasures.Finally,combining the causes of the dilemma and the problems existing in the legal countermeasures,the author attempts to propose suggestions for optimizing the measures and it is extremely important.This article has five parts.The background and practical significance of this thesis is the introduction,which is the first part of the thesis.The second part briefly introduces the author's main considerations as "social organization" and brief explanations of the relevant legal concepts for the government's purchasing public services from social organizations.The practical problems,reasons and hazards faced by the government in purchasing public services from social organizations are mainly discussed in the third part.The fourth part focuses on the legal countermeasures in the Chinese government's purchasing public services from social organizations and its deficiencies.The fifth part analyzes the problems raised in the fourth part and the reasons given in the third part,and tries to put forward the optimized measures that the government should adopt from the three levels of government,social organizations,and the public.
