A Review Of Local Legislation Research

After decades of development,local legislative research has achieved fruitful research results.The revision of the "Legislation Law" in 2015 further aroused the enthusiasm of researchers,and the number of theses is on the rise and the academic opinions are brilliant.Driven by the substantial expansion of local legislative power and the increasingly enrichment of local legislative practice,most of the local legislative research results are based on external perspectives,focusing on the censure of local legislative phenomena and their lack of self-examination and their calm review of their academic development.Therefore,this dissertation takes the local legislative research as an object,takes the public published,published and published works and the achievements of the subject as the research materials,and uses the methods of document measurement and word frequency analysis to explore the overall appearance,development context and academic characteristics of the local legislative research,To study whether the prosperity of local legislative research significantly enhances the construction of local legislative theoretical system,the development of conceptual terminology and the evolution of research methods,and on the basis of this,looks forward to the future direction of local legislative research.This paper analyzes: First of all,generally speaking,since 2000,the study of local legislation has mainly focused on the "Law of Legislation",which shows obvious stage characteristics in overall appearance.It can be divided into the analytical and exploratory stage of "Legislation Law" "Problem analysis phase and"legislative law "program to enhance the stage,three stages of research focus and academic output of different characteristics.Second,the construction of the theoretical system of local legislative research has not yet been completed.Most of the existing research results in the theory of textbooks,often on the general direction or principle issues put forward the relevant recommendations,neglected the application of technology and related methods,there is a clear lack of research content,the legislative process of basic research,specialized research and comparison weak.Finally,the local legislature research academic endogenous power to be nurtured local legislation to study the current prosperity mainly due to "Legislation Law" to amend such incentives and special public financial funds support,so academic output fluctuated,intermittent Not lasting,the research content is very scattered,and still cannot form systematic and unique theory.Based on the above analysis,this paper argues that future research work should focus on enhancing the professional standard of local legislative research,fostering a comprehensive methodology system,studying local issues and local practices,and highlighting the problem awareness of academic research And practice thinking,form their own characteristics of thinking and academic character,and promote the maturity and improvement of local legislative research.The main contents of this paper include:The first chapter mainly states the research questions,research methods and basic framework of this article.The second chapter shows the macroscopic view and the overall appearance of the local legislative research from the dimensions of the body of the local legislative research,the academic development vein and the carrying form of the achievements.It summarizes the research results of the local legislation in our country.The third chapter introduces the main topics of the local legislation research in detail,and analyzes the main achievements of the existing research in the aspects of the local legislation system,the quality of local legislation,the assessment of local legislation and the research on the relationship between the central government and the local government.On the basis of chapter two and chapter three,Chapter Four analyzes and reviews the general situation and main research contents of the local legislation,and finds out the main problems and shortcomings of the existing local legislation.The fifth chapter summarizes the research conclusions of the full text and looks forward to the future development of local legislation.
