Research On The Establishment Of A Legal Mechanism For China-ASEAN Cybersecurity Cooperation

The issue of cybersecurity is of critical importance.Its importance has been placed on the strategic height of major countries.The topic of this article is based on the comprehensive cooperation between China and ASEAN,and through the establishment of the China-ASEAN cybersecurity cooperation legal mechanism to safeguard the regional cybersecurity of China and ASEAN,so as to maximize the interests of cybersecurity cooperation between countries.This article is divided into four parts:The first part,for the overview of regional cybersecurity cooperation legal mechanisms,lists the definition of cybersecurity in different countries and the opinions of experts and scholars at home and abroad.Because the concept of cybersecurity is greatly extended,this paper defines the scope of cybersecurity.The cybersecurity cooperation legal mechanism has defined and defined the content,including cybersecurity law,cybersecurity treaty and cybersecurity related policies.The second part analyzes the current situation of China-ASEAN cybersecurity legal cooperation.Summarized the status quo and characteristics of China-ASEAN cybersecurity,as well as the status quo of legislation,summed up the deficiencies in the current China-ASEAN cybersecurity legal cooperation:(1)The degree of trust is not high,and the depth of cooperation is not enough;(2)The legal perfection is lack of pertinence,and the disagreement problem is not resolved;(3)legal system is not perfect;(4)lack of a unified coordination mechanism.The third part analyzes the necessity and feasibility of the establishment of the China-ASEAN cybersecurity cooperation legal mechanism.At the same time,it enumerates the legal mechanisms of the European Union,the United States,Japan,and the United States and Europe to learn about cybersecurity cooperation.The fourth part is about the construction of China-ASEAN cybersecurity cooperation legal mechanism.In the establishment of the mechanism,(1)the basic principles of respecting national cyber sovereignty,safeguarding cybersecurity,legality of state behavior,and governance according to law must be adhered to;(2)There is an established contradiction between cyber sovereignty and national security,and there is not enough trust between countries.The construction of this mechanism should begin with differences and operational aspects,such as handling cybersecurity incidents.The Cybersecurity Cooperation Team,Cybersecurity Incident Response Team and the Joint Enforcement Working Group to Combat Cyber Crime;(3)Basic agreements on cybersecurity cooperation with strong legal force and strong operability as cybersecurity basic legal documents for cooperation;(4)Establish Multi-level cooperation legal mechanisms,including information,technology,and talent sharing systems.
