Research On The Marriage Customary Law Of Daur Nationality

The Daur ethnic minority has a long history and a deep culture,and many customary laws have been formed in history.The traditional customary law of Daur marriage has distinct national characteristics,which has universal binding and coercive power on the Daur ethnic minority.For a long time,the Daur people have recognized and abided by it.Through the investigation of the self-governing flag of the Daur ethnic minority of Molidawa,this paper studies the changes of customary law of marriage of the Daur ethnic minority,whether there is the customary law of marriage at present,as well as the custom of the marriage conclusion of the Daur ethnic minority now.After interviews with the wedding industry in the town of Nilki,the village head and villagers of Tengk village,as well as the staff and researchers of the CPPCC National religious Committee and the Daur Autonomous Banner of the Molidawa Autonomous Flag,understand the current Daur marriage model basicly,many traditional Daur marriage customary law in the current society no longer have universal coercive and binding force on the Daur ethnic minority,and combined with national laws,most of the customary laws degenerate into traditional national customs and traditional national cultures,which exist as customs in the folk.Through comparing with the traditional Daur marriage customary law,this paper analyzes the causes of this series of changes,summarizes the current situation and development trend of the traditional Daur customary marriage law,to put forward some suggestions for the protection of the traditional Daur marriage.The article mainly includes five parts:The first part is the introduction,which made a brief summary and explanation to this article’s research significance,research background,research methods and so on,and by comparing with the most relevant research in this paper,it found the innovation and shortcomings of this paper.The first chapter mainly introduces the basic situation,historical evolution of Daur and the brief content of the customary law of marriage of the Daur ethnic minority.The second chapter introduce the specific contents of the traditional customary law of Daur marriage,including the basic principles,customary law of engagement and the procedure of the Daur wedding are elaborated in detail.The basic principles include extraethnic marriage,intra-generational marriage,monogamy,early marriage and parity marriage system;The engagement needs to go through the process of hiring a matchmaker and buying gifts,and the traditional daur ethnic minority should be given two rites,namely,"Chaente" and "Torriel";Daur marriage generally needs a man to meet,a woman to send relatives,wedding and returning also have unique provisions,at the same time,there are a small number of redundant son-in-law,child brides and the ’pulp for the marriage’ of the special form of engagement and marriage.The third chapter,taking the Daur ethnic minority of the self-governing flag of the Daur ethnic minority of Molidawa as the object of investigation,it is found that the current customary law of marriage of the Daur ethnic minority has changed,mainly reflected in the basic system of the traditional customary law of marriage of the Daur ethnic minority and the situation of the intermarriage of the Daur ethnic minority and the engagement and marriage procedure.The reasons for the analysis of affecting the changes include the following points:first,the development of science and technology and economy have led to the transformation of the basis of the production,life style and material conditions of the Daur ethnic minority,the second is that the establishment and popularization of the national law has affected the effectiveness and implementation of the traditional customary law of marriage of the Daur ethnic minority,the third is that affected by the pluralistic culture,and the fourth is the immigration policy implemented by Moqi in recent years,changed the Daur living conditions,ideas and other aspects greatly.The forth chapter,through the investigation of the current situation of Daur marriage customary law,it is found that most of the traditional marriage customary law has disappeared.This chapter analyzes the good fusion of the Daur marriage customary law and the state law.Although most of the customary law of marriage of Daur ethnic minority has been degenerated into national customs,in recent years the national culture has shown a good tendency to recover.On this basis,it is proposed that the intangible heritage can be declared actively,to strengthen the protection of Daur traditional wedding and Daur traditional culture.
