| With the popularity of the Internet,The phenomenon of infringement of Internet privacy is increasing especially the right of privacy on the Internet.Minors in our country nearly 160 million Internet users,Accounted for 1/4 of all Internet users.Due to the complexity of the Internet environment and the characteristics of minors,making the minors' right to online privacy more vulnerable to infringement.And our legislative protection of privacy is lagging behind,resulting in inadequate protection of the privacy of the Internet,protection of minors' right to online privacy is lacking.Minors are in the stage of physical and mental growth,the Infringement of privacy had a serious impact on their lives and learning.Minors are vulnerable groups due to their mind is not yet mature,should be subject to better special protection,however,due to the lack of social concern and the lack of legal protection,on protection of minors' right to online privacy is a serious challenge.In this paper,the use of literature research,case analysis,comparative analysis and other research methods,analysis the concept and characteristics of the privacy of minors Internet,Analysis of the phenomenon of infringement of minors' Internet privacy,and combing our relevant legal system,summarize the shortcomings of our country in protecting the privacy of minors' Internets;and then details of the EU and the United States in protecting the privacy of minors' Internets of the latest legislation,Finally,based on the actual situation in China,to put forward own ideas and suggestions on improving the legal protection of minors' right to online privacy.The article is divided into four parts except the conclusion:The first part analyzes the concept and object of online privacy,analysis of its difference with the traditional privacy,and summarizes the characteristics of minors' right to online privacy.The second part is the analysis current situation about the legal protection of minors' right to online privacy,this paper analyzes the characteristics and phenomena of infringement act,combined with typical cases to try to classify the phenomenon of infringement;carding the legislation of our country in protecting minors' right to online privacy,find out the shortcomings.The third part details the latest legislation on the protection of minors' right to online privacy in the EU and the United States,Analysis EU's "Right to Be Forgotten" in the "General Data Protection Regulation"and The United States special "Right to Be Forgotten" in the "eraser bill",summarize the significance of the protection of minors' right to online privacy.The fourth part is to perfect the legal protection of minors' right to online privacy,according to the status of domestic Internet environment,in the way of macro and micro,In improving the legislative system,clear the main body of responsibility and the establishment of relevant systems in three areas,put forward the ideas and suggestions to protect minors' right to online privacy,hope to provide some reference for the construction of the legal protection of minors' right to online privacy in our country,so that minors of minors' right to online privacy benefits can be achieved. |
