On The Improvement Of The Social Investigation System Of Juvenile Criminal Cases

The social investigation system in juvenile proceeding which carried out in China in 2012,is an important system in the juvenile criminal justice system.The social investigation system throughout the period of juvenile criminal lawsuit,is a full demonstration of which public security organs,people’s procuratorates and people’s courts shall fully implement the principles to educational,reformative,and redemptive guiding for juvenile and implement the principle of education first,punishment second.In the paper,I will review the origin and development of the social investigation system for understanding of social investigation system more regularity and the design concept and basic principles of the social investigation system.From the Angle of legislation,I will elaborate in detail on the social investigation system in judicial application mode and development status.On this basis,I suggest to perfect the social investigation system.The whole paper containing about 15000 words,is divided into 3 parts,excluding forward and conclusion.The first part is the overview of the social investigation system in juvenile proceeding.Through the origin and development of the social investigation system,a brief review on the concept and characteristics of social investigation system with more regularity.The second part is the development present situation of the social investigation system in juvenile proceeding.Studying at the top of social investigation system design concept,is to understand the social survey system in the legislation of China.In judicial practice,we have established three basic principles of comprehensive survey,lawful investigation,social participation,and so on.The third part is the improvement of the social investigation system in juvenile proceeding.In the judicial practice,the social investigation system has many problems。For example,the social investigationer is not unified,the content isn’t clear,the survey report for controversial issues,and so on.I will insist the actual situation and the demand of the judicial,stand on the realities of the country and absorb the excellent accomplishments.I suggest to perfection of the social investigation system in juvenile proceeding,in the construction of judicial institutions specialized construction of judicial system rigidity applicable auxiliary system,etc.
