Material and cultural heritage is the experience and spiritual inheritance that people accumulate in their survival and development.It is a bright part of human history and the crystallization of human wisdom.Intangible cultural heritage walks the attributes of different other cultural heritage,and its diversity and group are not comparable to other cultural heritage.There are four major parts in this study.The first part is the theoretical basis,mainly to introduce the theoretical basis related to this study,including the emergence of the concept of intangible cultural heritage,the way of identification of intangible cultural heritage and the significance of international protection of intangible cultural heritage from different angles;the second part is to explore the current situation of the protection of intangible cultural heritage from an international perspective,in the process,first of all,to international organizations The present situation of the protection of intangible cultural heritage is studied,followed by the basis of the protection of intangible cultural heritage from the three levels of international intellectual property law,human rights law and environmental law.Finally,the differences in the protection systems of intangible cultural heritage are obtained from the comparative analysis of four representative countries in Japan,Korea,France and China;The third part probes into the existing problems in the international protection system of intangible cultural heritage,including the difficulties existing in the inheritance,conflicts of interest,the lack of comprehensive protection of national cultural rights.The fourth part is based on the problems raised in the previous part to find solutions and explore the mode of intangible cultural heritage protection,as well as to grasp the way forward of intangible cultural heritage protection in China and improve the domestic protection mechanism. |
