Research On The Application Of Penalties For Environmental Pollution Crimes

The rapid economic development has brought great economic benefits to our country,but at the same time,the negative impact is gradually prominent,which is mainly reflected in the destruction of the ecological environment.The pollution of industrial production to air,water,land and other resources seriously affects our daily life and restricts the sustainable development of national economy.In recent years,the illegal and criminal acts of polluting the environment have increased dramatically,and the disposal of wastes and toxic substances by criminals at will has caused irreparable damage to the environment.Environmental pollution crime is the most important crime to punish this kind of crime.Whether its penalty is reasonable or not determines the punishment effect and environmental protection effect of this kind of crime.However,in the judicial practice,there are still many problems in the application of the penalty of the crime of environmental pollution,and the current situation of environmental protection is not optimistic.This paper analyzes the application of the penalty of the crime of environmental pollution in judicial practice,and puts forward corresponding improvement suggestions,which are divided into four parts:the first part outlines the legislative and judicial situation of the penalty of the crime of environmental pollution.The legislative situation is mainly elaborated from the initial stage and the development stage;the judicial situation is mainly empirical analysis from the case situation,the application of penalty and the application of sentencing circumstances.The second part to the fourth part respectively discusses the free penalty,fine punishment and probation,based on the statistical data to clarify the problems and reasons in the judicial application,and put forward the corresponding improvement suggestions,so as to promote the improvement of the penalty application of the crime of environmental pollution,give full play to the role and effect of the crime of environmental pollution,and better protect and repair the ecological environment.
