Research On The Soil Remediation Fund System Of Contaminated Sites In My Country

The lack of funds for soil remediation at contaminated sites is an important issue that currently affects the site remediation process.The existing financial system and financing mechanism are difficult to meet the huge funding needs of soil remediation,and there is an urgent need to establish a long-term financing mechanism.On January 1,2019,The Soil Pollution Prevention and Control Law of the People's Republic of China was officially implemented.It proposed that the state should increase investment in soil pollution prevention and control,establish a soil pollution prevention fund,and solve the financial problems faced by soil pollution through various means and channels.However,how to build the fund system has not been clear,and the source and use of funds have not been explained.At the same time,the law only authorizes relevant departments to formulate specific management measures,and does not explicitly specify the time limit for implementation,so that the operational and practical effectiveness of the soil pollution prevention fund system is greatly reduced.At present,there are still many problems in the soil remediation fund system for contaminated sites in China.For example,inadequate soil remediation laws,uncertain sources of remediation,unclear use of funds,and imperfect fund management practices.The paper combines the actual situation of contaminated sites in China,with reference to the extraterritorial legislative experience of the United States,the Netherlands,Germany and other countries,the soil remediation fund system for contaminated sites can be improved from four aspects.First,formulate management measures for soil remediation funds in contaminated sites.Secondly,broaden the source of funds.Establish a diversified fund-raising mechanism.Thirdly,clarify the scope and applicable conditions of the fund.Finally,improve the supporting system and do a good job of legal connection.It is hoped to guide the practice of soil remediation and provide reference for the soil remediation work of contaminated sites in China.
