Research On Network Market Supervision Of Industrial And Commercial Administrative Departments

In recent years,with the popularity and development of the Internet,network trade has emerged.As a new model of trade,it has exerted profound influences to both the sicio-economic lives and nationally economic security.Nonetheless,the Internet is endowed with virtuality,transaction without the limits of time and space.Therefore,more frequent are fraud,misleading propaganda and inabilities to guarantee consumers' legal interests in online exchanges.Such problems have challenged the supervisions of the industrial and commercial administrative departments who are responsible for the enforcement of law.Under the guidance of theories of “Market-failure” and government regulation,this paper has drew clear demarcation of the concepts of between online markets and the supervision,and analyzed the current condition of online supervision on trade of Henan province form three aspects: the fundamental situation of operating entities,the construction of the supervision systems and the methods employed.Moreover,this essay will take a classical case happened in Henan province as an example to illustrate the existing problems in the process of supervision and the courses.Through a thorough examination,there are several kernel points.Such as the imperfect network supervision laws and regulations lead to the emergence of supervision blind spots,the difficulties of obtaining evidence and the unbounded nature of the regulatory object posing new challenges to the supervision of the jurisdiction,the conundrum in implementing the protection of the rights of the network consumer,and the problem in confirming the network management entity.The reasons for the problem have been analyzed with examples.The whole passage has concluded the viable approaches in improvement from the following four aspects.They are establishing a sound law system governing the network market,supervising the Internet in accordance with laws in an all-round way,improving the informationization level of the network market supervision,realizing the network intelligence supervision,improving the collaborative supervision mechanism of the network market,adapting to the changes of industrial and commercial institutions,and further strengthening the construction of the supervision team.Drawing on the advanced experience and practices of domestic and international network market supervision,those industrial and commercial administrative departments of the Henan province actively explores new methods of supervising.Actually there are some achievements already.However,some problems are still to be resolved and combines the actual situation of the reform inthe commercial system which has centralized the actions of “deepening reforms to streamline government administration,delegating more powers,and improving regulation and service”.Through the analysis of the supervision concept,mode and implementation effectiveness of the industrial and commercial administrative departments,this paper attempts to further innovate the network market supervision mode,establish a network market credit mechanism system,strengthen the network market supervision system,and create a fair,healthy and orderly online market environment.
