On The Trust Of Rural Contracted Land Management Right

The problem of agriculture,rural and farmers(briefly called “Three rural issues”)has always been a major issue affecting the national economy and people's livelihood in China.The household contract responsibility system has greatly promoted the development of rural economy in China.With the progress of society,the rural land system at this stage has been unable to meet the requirements of the development of rural economy in China,we need to inject new vitality to the rural land system.The rural land system needs to inject new vitality.The introduction of the trust system for rural contracted land management right is an innovation of the rural land resources.At present,many areas of our country have been actively explored,and experienced the transformation from the government-led land trust pilot to the trust company actively participate in,and achieved some results.However,there is no doubt that our country still facing many problems,how to construct the rural land trust system and it's supporting system to ensure the smooth operation of trust circulation and its due advantage with the condition of the land ownership and contract management right are unchanged,and that all will be the focus of this article.On the rural contracted land management right trust,this paper will expand analysis in four chapters.The first chapter introduces the definition and characteristics of the rural contracted land management right trust and analyzes the rights and obligations of the client,the trustee and the beneficiary of the contracted land management rights in China.The second chapter analyzes the necessity and feasibility of rural land contracted management right trust system.The third chapter gives a brief analysis of the four trust modes of contracted land management right,on this basis we will find the problems in the operation and land trust.For example,there is lack of specific rules on the trust system for contracted land management right,irregular organization of trust intermediaries and lack of risk prevention and security mechanism.Aiming at the above deficiencies,chapter four focuses on the construction proposal of rural contracted land management right trust---perfect the "rural land contract law" : by clarifying the functions of land trust intermediary and promoting the role of land trust intermediary organizations in China to improve the land trust intermediary organization norms;actively improve the remedies,such as the establishment of specialized land trust banks,the establishment of compensation funds,the introduction of agricultural insurance;through a variety of ways to improve the supervision of management right trust.
