The property right system of state-owned agricultural land in our country is the practice of the reform of land property right system under modern agricultural production and management and social public ownership.Under the present situation of dual land ownership,how to protect the legitimate rights and interests of the users of state-owned agricultural land,arouse the enthusiasm of the operators,develop and utilize the state-owned wasteland resources efficiently,and promote the development of agricultural productive forces,Safeguard 1.8 billion mu cultivated land red line and food security,is an important foundation problem.At present,most of the research on the property right of agricultural land in our country is focused on the study of the property right of collective land in rural areas,and the system of state-owned agricultural land property right has not been put forward systematically.The problem of opening up wasteland lies in the imperfection of the property right system of state-owned agricultural land.The comprehensive complexity caused by the problem.The property right system of state-owned agricultural land is based on the clear property right by granting the economic parties,such as rural collective economic organizations,enterprises,individuals and agricultural cooperatives,the right to use,benefit and limited disposition of state-owned agricultural land resources.The sustainable development of agricultural land and its surrounding ecological environment can be promoted by supporting users to manage themselves independently and to improve the utilization efficiency of agricultural land resources.Based on the theory of property right,the theory of institutional change and the theory of sustainable utilization of land resources,this paper studies and analyzes the present situation of the property right system of state-owned agricultural land in Jinta County and the practical difficulties it faces by combing the general situation of the property right system of state-owned agricultural land in China.The author thinks that the present state-owned agricultural land property right system has some defects,such as fuzzy upper law,chaotic property right system,poor circulation of market,weak guarantee of property right and so on,which can not meet the objective demand of the development of socialist market economy in the new era.Can not adapt to the development of modern agriculture and rural urbanization of land property rights system requirements.This paper draws lessons from the good practices of the land property right system at home and abroad,and summarizes the practical experience of the state-owned agricultural land property right system in Jinta County.Clear thinking,direction of reform of state-owned agricultural land property rights system is divided into two steps,and puts forward some countermeasures for deepening the reform of the system,the recent construction of the state-owned agricultural land property rights system,clear responsibilities of the main task,the formation of the right to use as the core,right and right of lease contract management as the supplement system of property rights,to establish long-term the state-owned agricultural land property rights system development requirements of the new age as the ultimate goal,the formation of property rights transfer smoothly,continuously improve the social and economic value,resource utilization is the effect of ecological property rights system,and how to strengthen the Jinta County state-owned agricultural land property management work gives policy recommendations.In this paper,the research on the property right system of state-owned agricultural land conforms to the general direction of land system reform in China,which is beneficial to the standardized management of state-owned agricultural land,the rational development and utilization of state-owned wasteland resources,the protection of the legitimate rights and interests of the right holders,and the optimization of the allocation of agricultural land resources.To promote the overall development of agricultural land market in urban and rural areas is of guiding and referential significance for realizing the economic,social and ecological value of state-owned agricultural land to the greatest extent. |
