Research On The "Three Rights Disposition" Of Rural Collective Land Under The Background Of Rural Revitalization Strategy

The issue of the property rights of rural land in China has always been the focus of debate in the academic community.Although the research on the existing agricultural land property rights system is fruitful,it still has considerable deficiencies.In the face of the dilemmas such as the separation of man and land and the rural indigence that have emerged in the process of rapid industrialization and urbanization,the economics community has taken the lead in proposing the concept of"three rights allocation" of agricultural land,aiming to separate the contracting management right into contracting rights and operating rights.Improve the use of agricultural land.However,the "three rights allocation" is only a top-level design for the allocation of farmland property rights.The academia rarely explores the obstacles to the operation of the "three-power separation" system in rural areas from the perspective of history and reality,and it has not specifically proposed "Three powers separation" effective,operational and effective implementation.Under the background of the strategy of rural revitalization,the country has placed rural development under a more ambitious and comprehensive pattern.It not only emphasizes the backfeeding of the rural areas to the countryside,but also places greater emphasis on unlocking the closed state of rural areas,allowing market forces to intensify rural areas and revitalize rural areas.Resources to promote the two-way flow of urban and rural factors.It can be seen that the original intention of the "three rights allocation" coincides with the intrinsic requirements of the strategy for rural revitalization.Therefore,exploring the effective implementation of "three powers" has great theoretical and practical significance.The main theoretical basis of this paper is the core concepts of property rights and transaction costs in institutional economics,and the cost-benefit analysis in neoclassical economics.Using these basic theories,the second part analyzes the interworking mechanism between rural rejuvenation strategy and the "three powers division" of agricultural land,and argues that the "three-power separation" is the only way to rejuvenate the rural areas.The mechanism of the promotion of the new rural strategy.Afterwards,through peeping into the historical depth of China's farmland property rights allocation,we summarized the institutional logic of the formation and evolution of farmland property rights in different periods,as well as the positive and negative institutional performance.On the basis of historical analysis,in light of the actual needs of the agricultural land system,it is found that the ideal systemic effect of "three powers" should be brought into play,and there are still defects in the right itself and defects in the system environment.Finally,in the fifth part,the basic principles and some concrete measures for the formulation of the farmland policy were put forward with regard to the already existing defects in the "three-share separation".The principle of diversity,periodicity,synchronization and balance between efficiency and fairness of the agricultural property rights system aims to create a good external institutional environment for the operation of the "three rights allocation";to build an efficient collective economic organization and restore collective ownership benefits.The right to give legal status to collective economic organizations is an innovative measure to implement collective ownership,affirming the dominant position of the collective organization of the market,so that there is a reliable carrier of farmland property rights,and the exclusivity of farmland is greatly enhanced;the property attributes of affirming the right to contract are both To grant its inheritance rights,it is necessary to give contracting households the right to withdraw from the market pricing as a key measure for stabilizing the contracting rights;adhere to the independent production decision-making power of the business entities,and provide appropriate compensation for the positive externalities of the economic activities of the business entities,and ensure the operation Rights and interests.
