Research On The Access System Of Chinese Network Car

The birth of our country net rides in 2012,enter the public view is in 2014 or so,then all the way forward,rapid development.As a new thing,ride-sharing continues to grow and grow with a lot of controversy.The introduction of the "interim measures for the Management of Network booking Taxi Business Service"(hereinafter referred to as the "interim measures")in 2016 has shown that it is a legal act for China to recognize that the ride-hailing system is in operation.After the problem of legality is solved,the access system of ride-hailing has aroused people's attention.The market access of our country net rides belongs to the administrative license on the legal nature.The "interim measures" and the local rules for the implementation of the network of vehicles and drivers to set the administrative license is too low legal rank,violation of the principle of legality;For the local governments issued the implementation of the net contract rules there are illegal additional licensing conditions,improper procedures,access conditions set too strict problems;In practice,people often do not match the car,the driver abuse,beating passengers and other things happen.With regard to the problems existing in the system and its implementation,I think it is necessary to clarify the legal order of the legal documents regulating the net-ride-hailing system in order to standardize the legal basis for the net-ride-hailing access.At the same time,we should perfect the procedures of the normative documents and the setting of the specific conditions,and strengthen the supervision of the network by implementing the cooperation between the government and the platform.The main body of this paper consists of five parts: the first part mainly introduces the basic theory of the access system;The second part is mainly through the national and local network car charter normative legal documents combing and comparative analysis to understand the current situation of China's net car access system;The third part is in the understanding of the status quo after the analysis of China's network access standards and the implementation of the process ofproblems;The fourth part mainly analyzes the access system of foreign ride-hailing,at the same time obtains some enlightenment from its different practices;the fifth part is mainly to put forward their own views and suggestions to improve the access system of net-ride-hailing.
