Study On The Protection Of Labor Rights Of Pneumoconiosis

With the continuous development of industrialization and urbanization in modern times,the problem of pneumoconiosis has begun to appear in the world.Pneumoconiosis is common in high dust industries such as construction and mining.Laborers who work in these industries often make important contributions to industrialization and urbanization.These workers,after suffering from pneumoconiosis,want to use legal means to defend their rights.However,in terms of the reality of our country,It is hard for them to do this.Based on the serious facts of pneumoconiosis in China,strengthening the protection of pneumoconiosis workers is of great significance in solving the problems left over from the history of pneumoconiosis and reducing and eliminating the emergence of new cases of pneumoconiosis.This article mainly discusses the issue of the protection of the rights and interests of pneumoconiosis workers in four chapters with the ideas of “problem raising questions”,“analysing problems” and “solving problems”.The first chapter is definition of pneumoconiosis and the status of relevant legislation.Analyze the peculiarity of pneumoconiosis,and the difference between occupational pneumoconiosis and non-occupational pneumoconiosis,and sort out the current laws and regulations related to pneumoconiosis,and lay the foundation for the demonstration and discussion of the follow-up pneumoconiosis labor rights protection mechanism.The second chapter is about the problems of the protection of labor rights and interests of pneumoconiosis in China.The problems in the protection of labor rights of pneumoconiosis include the labor relations issues,problems in the diagnosis and identification system,compensation issues,and other issues in the protection of pneumoconiosis labor rights.The third chapter introduces the analysis of foreign labor systems related to pneumoconiosis.It is necessary to divide a chapter separately as a foreign legislation and experience comparison.Because many countries have experienced pneumoconiosis problems earlier than China due to the rapid development of industrialization,their current pneumoconiosis protection system is more perfect.Through systematic comparative research,we can konw the solution to the problem of pneumoconiosis in the other countries,which is easy for us to understand and learn from it.The fourth chapter is to improve the protection mechanism of labor rights and interests of pneumoconiosis in China.This chapter will provide targeted solutions to the problems existing in the current pneumoconiosis labor rights protection system,find a countermeasure that is suitable for China's national conditions and solve the difficult situation of pneumoconiosis labor rights protection.
