With the development of China's economy and society,and deepening of openness,more and more foreign laborers have been willing to enter into the labor market of our country,and also make great contributions to the social development.However,when the scale of foreign laborers has been expanding,the issue of employment management has become increasingly complex.At present,China does not have a comprehensive law on the entry and employment management of foreign laborers.The relevant contents are primarily stipulated into the regulations and documents of various departments.And also,there are many administrative departments involved into the work of managing foreign employment,since the lack of clear management subjects.What's worse,there's a lack of joint cooperation between those departments,consequently that it leads to the problem of information not sharing with each other and interactions are not smooth among them.From the perspective of legal norms,some of the regulations are no longer meeting the requirement of foreign laborers' management.And in terms of those management models,they are not able to effectively and comprehensively manage foreign laborers' behavior yet.Therefore,the entry of foreign laborers and the employment management system need to be improved greatly and updated immediately,so as to better carry out management work and enhance the benefits of foreign laborers to the labor market in China.In addition to the introduction and conclusion,this paper is divided into four parts.The first part discusses mainly about the current foreign laborers' situation in China,especially three types of employment,and as well the geographical and industrial distribution in our country.The second part emphasizes strongly on the current legal system of foreign laborers entry and employment management in China.First of all the analysis to the entry system on the basics of the following three levels,such as system development,introduction of stratification,and labor certifications.Secondly,analyzing the current employment management system of foreign laborers from three aspects,including the development of the system,the subject of the system and the application,permit and change of labor certification.And then,having a discuss on the protection of labor and social security rights of foreign laborers.Finally,finding out the problems existing in the current system,so as to pave the way for the following solutions.The third part gives an introduction of the foreign laborers management system in the United States.Focusing on three systems including the labor certification system,labor market testing system and employer verification system.After these introduction,analyzing the situation of protection of labor and social security rights of foreign laborers,and summing up the experience of improving China's relevant systems.The fourth part starts from the construction of China's new foreign laborers entry and employment management system,and from the entry method to the management department,from the visa type to the labor and social security rights of foreign laborers,to puts forward suggestions for improving the corresponding system in China.
