In constant progress under the background of the labor of the rule of law construction in our country,labor relations to enhance subject consciousness of rights and interests demands more diversified,the number of labor dispute cases are also on the rise.Among them,the non-compete agreement disputes were highlighted in the labor dispute cases,this is because of its own has the characteristics of complexity and multiple,make it become the important content of the current labor dispute judicial work.For theoretical and practical circles "non-compete" legal system also has many disputes,such as the cognizance of the non-compete agreement,the amount of economic compensation and confirmation of payment,the terms of the non-compete period,legal responsibility of breach of non-compete obligation and controversy.Though,of non-compete legal system in our country's current legal provisions,but still can't the disputes to complex non-compete agreement comprehensive summary,in the practice of the local provincial and municipal judicial understanding provisions,the law also has bigger difference.This paper from a typical involving "non-compete agreement" the labor dispute cases in hand,in the case in the arbitration tribunal and the court at all levels determine the results of analysis and induction,contact the business secret protection unit of choose and employ persons and laborer freelancers rights legislation purpose,together with the present situation of labor relations teasing out the controversial focus in such cases,on this basis,the "non-compete" to further perfect the legal system.In addition,through the detailed analysis of the non-compete agreement legal issues,in order to non-compete agreement in their Labour contract legal issues research provides new ideas,provide reasonable and effective theoretical reference for the practice,in order to integrity of fair competition order in the field of labor relations.
