Labor dispatch is a new form of employment in the past half century.The dispatch unit "employing people" and the employing unit "employing people" are the main characteristics of labor dispatch which are different from other forms of employment.The extensive use of labor dispatch personnel meets the needs of flexible employment of many employing units,and labor dispatch plays a very important role in promoting the re-employment of the unemployed.However,the labor dispatch industry is still in development,and there are many problems,such as the low quality of employment,unfair treatment,labor dispatch on the formal employment "transition crowding out" and so on.These problems are concentrated on the rights and interests of labor dispatch personnel have been encroached.Besides the introduction and conclusion,there are four parts in this paper.In the first part of this paper,the basic theory of labor dispatch is summarized.Combining with the government's policies on labor dispatch,the classification and characteristics of labor dispatch are discussed,and the concept of labor dispatch is redefined.Combined with several theories disputed by domestic scholars,the legal relationship of labor dispatch is expounded systematically,which is the following part It also introduces the connotation,nature and main types of labor dispatch rights,demonstrates the rationality of the existence of labor dispatch rights,and broadens the train of thought for the following system ideas.The second part analyzes the main problems of labor dispatch and draws the conclusion that the system loopholes exist under the existing legal framework,which are reflected in the widespread phenomenon of unequal pay for equal work,the lack of protection of the right to occupational safety,the restriction of the exercise of the right to associate and the popularization of social insurance.It reflects the necessity and urgency of promoting the construction of labor dispatch personnel rights protection.The third part analyzes the causes of the obstacles to the protection of the rights of dispatched personnel.The concrete manifestations are the unclear identification of the three characteristics,the low threshold of dispatch access,and the weak punishment.It discusses the conflicts of various rights and phenomena in dispatch of labor services,paving the way for the following system to avoid conflicts.The fourth part is the focus of this paper.According to the reasons for the infringement of the rights of labor dispatchers,the author puts forward some suggestions to protect the rights of labor dispatchers,and puts forward a reasonable system structure in line with the national conditions from the aspects of fair and reasonable distribution mechanism,supervision and management system,collective consultation system and accountability system.I hope to promote the efficient and orderly development of labor dispatching in China.
