China's economic development has entered a new normal,and the transformation and upgrading of the economic structure will inevitably affect the interests of micro-enterprises,and thus affect the interests of workers.Labor-management relationship is not only a social relationship,but also an economic interest relationship.The issue of interest distribution is the core issue of common concern of employers and employees.Based on the data of labor disputes in the past 20 years,this paper analyzes the status of labor relations in China's labor relations and the possible obstacles to the realization of harmonious labor relations,and focuses on the labor relations governance mechanism based on labor property rights,emphasizing the value of labor.Affirming the contribution of laborers' human capital,laborers should enjoy labor property rights,especially part of the residual claims of labor property rights,compared with the capital property rights of employers.Establishing labor property rights,realizing equality of property rights between employers and employees,sharing common corporate surpluses,fundamentally protecting the legitimate rights and interests of laborers,and narrowing the economic interest gap in labor-management relations is an effective way to govern labor relations.The research in this paper helps to change people's understanding of the concept of "capital wage labor",realizes the one-sidedness of "capital labor",and is also conducive to improving the current enterprise system of unilateral governance of capital,and has an important reality for the construction of harmonious labor relations,significance.The main content of this paper is divided into six chapters.The first chapter briefly discusses the research background,research significance and research methods of this paper.The second chapter defines the concepts of labor property rights,labor relations and labor relations governance in this paper,sorts out the literature review related to the topic selection,and discusses the theoretical and practical basis for the establishment of labor property rights.The third chapter mainly discusses the necessity of establishing labor property rights from three aspects:the status of labor and capital,the main status of laborers in socialist countries and the defects of current labor relations governance mechanism.The fourth chapter analyzes the characteristics of labor relations in China during the transition period and the occurrence and treatment of labor disputes,including the rising trend of labor disputes,the causes of labor disputes and the diversification of labor disputes.After that,this chapter analyzes the factors affecting the construction of harmonious labor relations.The simple analysis of the unilateral governance of the employer,the deviation of the role of the government and the weak role of the social organization leads to the analysis of the obstacles to the lack of labor property rights.The fifth chapter focuses on the analysis of labor relations governance mechanism based on labor property rights,including(1)the participants and their connections of labor relations governance mechanism;(2)establishing the connection between labor property rights and labor relations governance;(3)labor property rights in labor The operational mechanism in the relationship governance mechanism;(4)the balance of the labor relations governance mechanism;(5)the practical case of the labor relationship governance mechanism based on labor property rights.The sixth chapter proposes policy recommendations for improving the governance mechanism of labor relations.It mainly proposes policy recommendations from the aspects of government functions,establishment of labor property rights system,improvement of income distribution system,strengthening of laborer's subjective consciousness and corporate social responsibility awareness,and establishment of an enterprise system of equal sharing of labor and management.
