The Research On The Rights And Interests Of College Students From The Angle Of Education Consumption

After the expansion of university enrollment in 1999,the scale of college students in our country has been expanding continuously and the tuition fees have been greatly increased.As college students receiving higher education service,they are no longer simple educate persons,they have become consumers in education service.In other words,the relationship between the university and the students has become essentially a consumer legal relationship.Due to the relative lag of people's ideas,the current legislation and judicature have limitations,which leads to the legal rights and interests of higher education service consumers in our country are not adequately protected.It is of great significance to pay more attention to the protection of consumers 'rights and interests in higher education services to construct a harmonious educational consumption environment and promote the rapid and stable development of education in China.What is the specific status of consumer rights infringement in education? What is the reason for the increasing number of educational disputes in recent years? What are the ways to protect educational consumption rights and interests? These questions are worth exploring in depth.This paper takes "the research on the rights and interests of college students from the angle of education consumption" as the topic,firstly,introduces the concept and related theories of "education consumption","higher education service consumers" and "university students 'rights and interests",and expounds the differences in our country's understanding of education consumption.Secondly,the rights and interests of consumers of higher education are divided into the right to education,right to security,right to information,right to privacy,right to appeal,right to claim,fair evaluation,right to supervision and right to income.Thirdly,a questionnaire survey was conducted on the current situation and existing problems of the rights and interests of college students in education and consumption in China.Data and data analysis showed that: firstly,the phenomenon of infringement of the rights and interests of college students is widespread;Secondly,College Students' awareness of rights and interests is not accurate.A considerable proportion of college students think that they are managed.This position makes the students blindly obey the management and dare not resist;Thirdly,the awareness of the rights and interests of college students is weak;and Finally,some students lack the legal belief and often give up the use of legal means to protect their rights and interests.At the same time,this paper analyzes the causes of the above problems: first,the influence of the inherent ideas,college students difficult to establish the consciousness of the subject and the awareness of rights,second,lack of legal protection,the existing rules are unclear and formal;Third,the service consciousness of colleges and universities is low and the consumers of higher education are in a weak position.Cases involving students 'right to education,right to information,right to personal and property security and right to benefit from education are classified and analyzed,such as cases of students being expelled from schools for cheating or discipline,students being expelled from schools for being pregnant during school,schools being sued for failing to pay off a loan and failing to obtain a diploma,and,more specifically,schools being sued for compensation for unsatisfactory schools.Finally,based on the analysis of the reasons for the problems in the current process of protecting the rights and interests of college students 'education and consumption and the analysis of typical cases,this paper puts forward some suggestions to strengthen and improve the protection of the rights and interests of college students' education and consumption services: train the consciousness of college students 'self-protection and improve their self-protection ability;To raise the consciousness of educational service in colleges and universities and establish the concept of "governing schools according to law";Improve the construction of relevant legal system to meet the needs of reality;We will strengthen the supervision of administrative departments and further enrich the existing means of supervision.
