Part-time work is a typical form of non-standard employment.Its flexibility characteristics cater to the needs of the development of market economy.It develops rapidly in China and becomes a necessary supplement to the typical employment form.To a certain extent,part-time employment has made up for the shortage of labor employment forms,and it is necessary to exist.But behind its development,there are many problems that need to be perfected: lack of adjustment in related labor laws and regulations to part-time employment,unstable labor relations,and no equal treatment with full-time employment.These problems are not conducive to the balance of the rights and obligations of both sides,and in the long run,it is not conducive to the development of part-time employment.China’s current laws and regulations only provide for the part-time employment only the principle stipulation,the stipulation is few and dispersive,the system is overall degree is bad,cannot play the role of protecting the rights and interests of the part-time labor labourers.On the basis of related literature,comprehensive arrangement and summary,this paper discusses the part-time employment.In addition to the introduction and conclusion part,this paper is divided into four parts to study the legal regulation of part-time employment:In the first part,a brief interpretation of the concept and particularity of part-time employment is made.The concept of part-time employment is defined from two aspects,and the particularity of the part-time employment is analyzed on the basis of the concept of non full-time employment.To clarify the labor relation of multiplicity and freedom,a labor contract flexibility and pay the diversity.The second part makes a brief analysis of the legislative idea and value orientation of the non full time employment norms in China.The first section is the value orientation of the standard.The second section introduces the current legal system of part-time employment in China.From these two aspects,we can find out the problems of part-time employment on the basis of profound understanding.The third part,the main problems existing in the current legislation in China.Through the analysis of the current laws and facts,it is found that the attention and understanding of the legislation in our country are insufficient.In practice,the provisions of contract rules are too flexible,and the wage system and vacation system are not enough to protect part-time workers,and the rights and interests of workers are seriously infringed in the insurance legislation.The fourth part is the perfection of the system of part-time employment in China.First of all,the legislative idea of the legislative concept of "rigid in the soft,rigid and flexible" legislative concept.Secondly,in a reasonable range,the rights of the employers are restricted and the part-time workers are protected.Thirdly,it puts forward some suggestions on the work time,insurance,vacation and other issues stipulated in the labor law.Through the above measures,the relevant legislation of part-time employment should be perfected to promote the harmonious and healthy development of part-time labor relations.
