Research On The Predicament And Way Out Of Combating Cultural Relic Crime In Shanxi Province

Cultural relics are important non renewable cultural resources.The protection of cultural relics is of great significance to the inheritance and promotion of China's excellent traditional culture,the maintenance of the national spirit of the Chinese nation,and the construction of socialist core values.Shanxi is a big province of cultural relics in China,and the resources of ground and underground cultural relics are extremely rich.In the history of Shanxi Province,cultural relic crime is more prominent,and it has been more rampant since the 1980 s,and the action of combating cultural relics crime has never stopped.Since 2018,the public security organs of Shanxi Province have carried out a three-year special campaign against cultural relics crime in the whole province in combination with the national anti-corruption special struggle,which has made certain achievements and is also facing great difficulties.In this paper,combined with Shanxi's special action to combat cultural relics crime since 2018,this paper analyzes the difficulties faced by Shanxi Province in combating cultural relics crime,and explores the way out to combat cultural relics crime.The article includes four parts.The first part,on the basis of defining the concept of cultural relics,cultural relics resources and cultural relics crime,mainly introduces the situation of cultural relics resources,the distribution of cultural relics,the cultural relics cases,the protection of cultural relics in Shanxi Province,the overall situation and main characteristics of the crime;the second part analyzes the cracking down on cultural relics in Shanxi Province The specific measures and achievements of the special action include mechanism construction,investigation measures,team building,management and transfer of cultural relics involved in the case,security precautions and other aspects of the public security organs;the third part analyzes the difficulties faced by Shanxi Province in cracking down on cultural relics crime,which are mainly divided into technical difficulties andpolicy difficulties.Technical dilemmas include the difficulty of finding case clues,grasping the escaped criminals of cultural relics,cracking down on protective umbrella,recovering overseas cultural relics,and recovering cultural relics crime assets.Policy dilemmas include the application of law,the implementation of incentive mechanism,the construction of team and the prevention of crime.The fourth part puts forward the way out for Shanxi Province to crack down on cultural relics crime,including technical way out and policy way out The main way out is to actively collect and expand the source of cases,clean up fugitives by special teams,strengthen the attack of protective umbrella,establish a new mode of overseas cultural relics recovery,and increase the strength of asset recovery.The policy solutions include blocking legal loopholes in the field of cultural relics crime,improving the incentive mechanism of cultural property crime,strengthening the construction of professional team,and improving the system of preventing cultural relics crime.
