Research On The Legal Issues Of Long-term Care Insurance

China has become the second largest economy in the world,and its economic development is at a high level.At the same time,we should also see the challenges in the development process and face up to the problems in the development process.The first problem that we should pay attention to and solve is the aging of the population.As a result of various efforts to solve the problem of population aging,such as the improvement of the medical and health system,the promotion of the family planning policy,and the greater emphasis on equity in social redistribution,the care of the disabled elderly should be paid more attention to.The emergence of the long term care insurance legal system aims to solve the problem of care for the disabled elderly,which is one of the social problems caused by the aging population,and it is an important aspect.Long-term care insurance has gradually developed into a social security service project that pays equal attention to medical treatment and old-age care.We should be keenly aware of the problems in our country at the present stage.The aging population is accelerating,the medical care level for the elderly needs to be improved,the urban-rural development gap is large,and the old-age care,nursing and medical costs are high.It can be seen that the current stage of our country’s social security is not perfect and other livelihood problems need to be solved.From the perspective of protecting the rights and interests of the elderly,from the perspective of social development,from the perspective of the realization of the great vision of socialism,it is imperative to establish a legal system of long-term care insurance that is in line with China’s national conditions and accepted by the people.At the same time,we should draw lessons from the advanced experience of other countries,give full play to the advantages of the system,and establish a practical and effective long-term care insurance legal system in line with China’s national conditions.China has developed into the world’s second largest economy thanks to the continuous development and improvement of China’s socialist market economy system and the establishment of relevant supporting systems and facilities.At the same time,in order to better serve the people and let them feel the fruits of development,we have also established a basic social security framework with central and local levels of responsibility.We should also be soberly aware of the current potential crisis that inhibits social development--population aging,and this crisis will become more and more severe.Hence the importance of the concomitant long-term-care insurance system,which not only satisfies people’s urgent need for a better life,but also improves our social security system.Since 2016,the state has established a legal system of long-term care insurance in 15 cities as a pilot project.We will make a comparative analysis of the legal system of long-term care insurance in Shanghai,Qingdao and jilin provinces,and summarize the experience and deficiencies in the system construction.On this basis,we also learn from foreign advanced experience,Germany,Japan and South Korea’s long-term care insurance legal system comparative analysis,on the basis of adhering to the truth from facts,respect for the national conditions,draw on the advanced experience in foreign laws,to establish and improve China’s long-term care insurance legal system.This paper,from the perspective of long-term care insurance participants,financing methods,payment forms,and so on,combined with international experience and domestic practice,gives the legislative direction and improvement Suggestions for the establishment of long-term care insurance legal system in China.
