Since the eighteen Party's Congress,the Party Central Committee with Comrade Xi Jinping as the core has positioned the rule of law to the strategic height of the long-term stability of the party and the state.General Secretary Xi Jinping has made great achievements in affirming the construction of the rule of law,and has also pointed out a new way to comprehensively manage the country according to law.The law is the important tool of governing the country,and the good law is the premise of good governance.General Secretary Xi's important instructions on the legislative work have also become the basic compliance of the legislative work in the new era.Peng Zhen is one of the main founders of China's legal system construction.He has made great contributions to the liberation of the Chinese people and the birth of new China,to the socialist revolution and construction,especially to the socialist democracy and legal system construction,and has built immortal achievements.Peng Zhen attaches great importance to the study of theory and summary and reflection in the long-term practice of political and legal work.The combination of theory and practice has formed Peng Zhen's rich and scientific legislative thought.Under the guidance of his legislative thought,Peng Zhen has made outstanding contributions to China's legislative work,especially after the Third Plenary Session of the Eleventh Central Committee,he presided over the revision of the 1982 constitution and led He formulated a series of important laws and greatly promoted the construction of socialist legal system in the new era.The formation of the legal system of socialism with Chinese characteristics is not smooth.Once again,looking back on this process,Comrade Peng Zhen made efforts and explorations during the period of presiding over the work of the Standing Committee of the National People's Congress.His profound legislative thought has become a pearl in the history of China's legislation.The establishment of the framework of the legal system of socialism with Chinesecharacteristics cannot be separated from his historical contributions,By studying the formation,content and characteristics of Peng Zhen's legislative thought,we can get the enlightenment for the promotion of legislative work in the new era,and realize the unity of theoretical value and practical value.This paper mainly uses the methods of literature analysis,historical analysis and value analysis to sort out the development results of Peng Zhen's legislative thought in each stage,summarize and classify Peng Zhen's legislative thought in horizontal direction,summarize and reveal the main characteristics of the legislative thought,and conduct theoretical analysis and research combining with the hot issues in the current legislative process in China.This paper is divided into four parts: in the first part,taking time as a clue,the formation process of Peng Zhen's legislative thought is combed vertically.This historical process is divided into the embryonic stage(1929-1949),the development stage(1949-1979),and the improvement stage(1979-1997).Combining the history of China and Peng Zhen's life,the specific development of his legislative thought in each stage is combed.The second part mainly introduces the content of Peng Zhen's legislative thought.In this part,the author classifies and generalizes the main contents of Peng Zhen's legislative thought horizontally,which is divided into five modules:legislative basis theory,legislative purpose theory,legislative methodology,legislative technology theory and legislative leadership theory The third part mainly sums up the main characteristics of Peng Zhen's legislative thought.Starting from the formation and content of Peng Zhen's legislative thought,this part summarizes the most prominent characteristics reflected in the legislative theory and practice work,that is,the combination of practicality and theory,the combination of enthusiasm and prudence,the combination of principle and flexibility,and analyzes these three characteristics.In the fourth part,guided by the Enlightenment of Peng Zhen's legislative thought,combined with some hot issues in thecurrent legislative process of our country,Including the contemporary legislative concept,the contemporary legislative mechanism,the contemporary local legislative hot spots and the contemporary legislation issues led by the party,the legal theory research is carried out.In this part,the author is not limited to the direct enlightenment of Peng Zhen's legislative thought to the contemporary legislative work,but combined with the characteristics of the times This paper makes divergent thinking on the Enlightenment of Peng Zhen's legislative thought,in order to see higher and farther on the shoulders of predecessors.
