An Analysis Of The Rights And Obligations Of Voluntary Guardianship Contract Subjects

In the 2017,the "general principles of civil law" in China established the adult guardianship system in our country by revising the guardianship system of the original rules of civil law,and introduced voluntary guardianship.The "general principles of civil law" in China has initially constructed the basic framework of voluntary guardianship,but because its provisions are too principled and abstract,its proper functions can't be brought into full play.The right and obligation of the subject of the contract is the core of the contract,this paper focuses on the analysis of the rights and obligations of the parties in the contract by analyzing the nature and content of the voluntary guardianship contract,for example,whether the guardian has the right to claim compensation and whether he has the right to resign.In addition to the introduction and conclusions,this article is divided into four parts to discuss.Firstly,it briefly describe the voluntary guardianship contract.Secondly,it analyzes the rights and obligations of the parties to a voluntary guardianship contract from the perspective of guardianship system.Thirdly,it analyzes the rights and obligations of the parties to a voluntary guardianship contract from the nature of the agency.Fourthly,it analyzes the rights and obligations of the subject of the custody contract from the perspective of the commission contract.
