| With the in-depth development of "Internet +",the emerging technology industry of the Internet has risen rapidly.Since 2016,webcasting has become a new type of online social media.With its unique sense of presence and immediacy,it has been welcomed by users.The number of webcast users has increased dramatically.In 2018,the number of webcast users in China reached 456 million,and the growth rate of users reached 14.6.%,the user scale maintained a growth rate of 22.6%.However,in recent years,due to the delay of algorithmic governance and the hidden factors of the network,the live broadcast industry has emerged such as illegal performances,privacy risks,live crimes and other chaos.Relevant departments have successively introduced laws and regulations to actively rectify the phenomenon of live webcasting.The live webcast chaos highlights the imperfect legislation of the existing live webcasts,and the laws and regulations of the live broadcast of the Internet do not play a corresponding regulatory role.The lack of legislation on the live broadcast of the Internet has become a constraint to the development of the live broadcast industry.Therefore,it is necessary to comprehensively sort out the status quo of China's online live broadcast legislation,demonstrate the rationality and operability of the current live broadcast legislation,reflect on the problems in the live broadcast legislation,and analyze the network.The reasons for the lack of live legislation are put forward,and corresponding legislative proposals are put forward to promote the improvement of China's online live broadcast legislation and promote the sound development of the entire network live broadcast industry.This article is divided into three main parts:The first part is the analysis of the status quo of China's online live broadcast legislation.From the perspective of China's online live broadcast legislation system,legislative body,main legislative content and legislative procedures,the current situation of China's online live broadcast legislation is summarized.The characteristics of live broadcast legislation are summarized,which lays a foundation for the analysis of online live broadcast legislation.basis.The second part is the analysis of the legislation and its causes of the live broadcast of the Internet in China.At present,the legislation of the live broadcast of the Internet has low level of legislation,the operability and effectiveness of the live broadcast law,the lack of legal protection of the rights of users of the live broadcast service,and the legislative process.The masses participate in limited issues,analyze the causes of the problems in order to better find improved strategies.The third part is to solve some problems in the legislation of webcasting and put forward corresponding suggestions for improvement.The legislation of webcasting needs to raise the level of legislation,strengthen the operability and effectiveness of the law of live broadcasting,strengthen the legislative protection of the rights of users of live webcasting,improve the public participation in the legislation of live broadcasting,improve the legislative system of live broadcasting in China,and promote development of the webcast industry. |
