An Analysis Of Ancient Chinese Judicial System

Jurisdiction refers to the power of a country ’s courts or judicial institutions to hear and try litigation.In the Shang and Zhou dynasties of China,jurisdiction has begun to appear.There are not only Hierarchical Jurisdiction,but also regional jurisdiction and special jurisdiction for specific groups of people in the litigation.In some dynasties,the system is complete and the content is rich Showing diversity.Each jurisdiction has been handed down from ancient times,and its origin,evolution,content and characteristics will help us to better grasp the characteristics of traditional litigation,absorb the essence of China’s legal culture,and serve the construction of socialist rule of law with Chinese characteristics.However,in recent years,the domestic scholars’ research articles on ancient jurisdiction mostly focus on the jurisdiction system of a certain Dynasty,or only on the level of jurisdiction of a certain Dynasty,but not on the overall system of ancient jurisdiction.The ancient jurisdiction is in the same line.The later Dynasty will inherit the legacy of the former dynasty more or less.Studying a dynasty alone will inevitably fall into the metaphysical trap.On the basis of historical materialism,this paper attempts to use the empirical method of historical materials,draw lessons from the existing research results,and combine with the provisions of the ancient jurisdiction system and the operation in practice in our country,to make some more in-depth analysis and Research on the judicial jurisdiction system and its implementation,in order to better understand the traditional Chinese legal system.The development of a country’s law should not and cannot leave the traditional platform.It is extremely necessary to critically absorb the legal tradition,because it condenses the traditional culture and spirit of the nation.The only way to build a socialist country ruled by law is to understand the intention behind the traditional legal system and form a unique mode of rule of law in China.
