As adjudicators,the quality and capability of judges is an important factor in determining judicial justice,which means that judges must meet the requirements of professionalism and elitism.No matter what kind of legal system,only when the practitioners are in the best state on the whole can the system play its most important role.Therefore,it is of great importance to select judges by what standards and in what ways.The scientificity and integrity of judge selection system is the key to build an excellent judge team,which is also the system guarantee of fair justice.The selection system of the junior judge is one of the main contents of the selection system of the judge,controlling the "entrance" of the judge team and ensures the high-quality talents to join.The selection of the junior judge is closely related to the social development,economic construction and the process of rule of law of the country.The system has been developed and improved in successive reforms,and there is no general system model.The new round of judicial reform provides a stable system foundation and superior policy conditions for the establishment of a scientific and reasonable system to select junior judges,which is a good opportunity to improve the capacity of judges and build a legal professional community.At present,there are many problems in the system of selecting junior judge in our country,including the low access qualification of the judges,the administration of the selection procedure,and the ambiguity of the selection subject.Therefore,when we improve the selection system of the junior judge,we should focus on specific problems and put forward the corresponding solutions.First,on the basis of the value pursuit of fairness and justice,the requirements of the construction of judges’ elitism,and the requirements of judicial independence,we need to make clear the necessity of improving the selection system of the initial judges.Second,in terms of strict access qualifications of judges,we should improve the requirements for academic qualifications,professional experience in legal work,and pay attention to the professional ethics of judges.Third,we need to improve the judge selection process.The assessment content should be different from that of ordinary civil servants.We should set up assessment standards that match the work of judges,set up professional selection agencies and ensure the diversity of selection committee members.Last,we need to improve the relevant supporting systems,including the pre-service training system and supervision mechanism for the first judges.The construction of rule of law in China is moving forward steadily.It is necessary to establish a scientific and rigorous system for the selection of junior judges,but it cannnot achieved overnight.According to the actual situation of the country,we need to learn from foreign countries,analyze the specific problems,attempt and break through constantly to achieve the goal of building a team of high-quality judges. |
