In recent years,the game industry has been booming by taking advantage of emerging technologies,and its expressions have become increasingly abundant.Live broadcasting of game has the characteristics of fast spread and non-specificity,and occupies an important position in the game industry.At the same time,many problems have emerged,among which the problem of copyright infringement has become increasingly prominent.The current copyright law in China has been unable to adapt to the emerging game live broadcast environment.In order to adapt to the development of the times,standardize the chaos in the live broadcast industry promptly,and better protect the legitimate rights and interests of right holders,it is imperative to study the copyright issues that exist in live broadcasts of games.Games are divided into competitive games and plot games.The controversy caused by different types of game live broadcasts is different.The academic research on the issue of online game copyright is relatively general,and there is no distinction between game types.In order to more accurately analyze the infringement of the game live broadcast industry,according to the specific characteristics of live broadcast of story games,this article delves into the copyright issues involved in the live broadcast of the plot game.In recent years,the case of Wangyi v.Huaduo has attracted much attention.The Fantasy Westward Journey is a classic story game.Through an in-depth analysis of this case,this paper will provide certain theoretical guidance for dealing with live broadcast disputes in plot games,improve the copyright research system of the live game industry,safeguard the legitimate rights and interests of relevant rights holders,create a healthy and orderly live game environment,and promote the rapid development of the live broadcast industry of games.This article analyzes four controversial focuses in the case of Wangyi v.Huaduo,discusses some copyright issues involved in the live streaming of plot games,analyzes the deficiencies of some provisions of the current copyright law in China,by drawing on foreign experience,puts forward corresponding suggestions from the two aspects of legislative perfection and judicial regulation.The full text is divided into five parts.The first part mainly explaines the research background and significance,the research status at home and abroad,research content and methods.The second part mainly elaborates the basic case and the dispute focus about the case of Wangyi v.Huaduo.The third part mainly studies the legal theory of the four points,and puts forward the position of this article for each controversial point.The fourth part mainly combs the relevant legislation and jurisprudence on the copyright issues of online plot games outside the domain.The fifth part puts forward corresponding suggestions to the relevant content of copyright law from two aspects of legislative improvement and judicial regulation.
