Study On The Legal Issues Of House Expropriation Compensation In The Reconstruction Of Villages In The City Of Tengzhou

In recent years,China’s economic development is changing with each passing day,the steady progress of urbanization,followed by the city in full swing around the village transformation work.With the transformation of the work,the collective land was expropriated,and the houses on the land were also inevitably expropriated.The house expropriation in the reconstruction of villages in City is a comprehensive work involving many factors such as law,economy,politics and so on.However,in view of the collective land housing expropriation compensation,there is no specific national level of laws and regulations to regulate its.In the course of collecting houses for rebuilding villages in cities in some areas of China,the legal rights and interests of the expropriated villagers have not been fully protected,leading to various kinds of conflicts and disputes,which have aroused wide concern from all walks of life.Therefore,through the legal angle of view,this article takes the House collection compensation in the city village reconstruction of Tengzhou City in Shandong Province as an example,studies its existence legal question,and puts forward the consummation collection compensation reasonable legal justice proposal,with a view to better defend the legitimate rights and interests of the expropriated villagers,maintain social harmony and stability,and promote the smooth transformation of urban villages.Firstly,this paper introduces the relevant concepts of the compensation for house expropriation in the reconstruction of village in city,and sorts out the theoretical basis and legal basis involved.Secondly,it makes a case study on the compensation of House expropriation in the reconstruction of village in City in Tengzhou,by analyzing the present situation of the compensation for Expropriation and the Local ordinance on which it is based,the advantages and legal issues of the compensation for the expropriation of the reconstructed houses in the villages in the city are summarized,this paper analyzes and studies the relevant laws and regulations of some countries outside the region and different cities in China,and obtains the corresponding enlightenment from them.Finally,in view of the legal problems mentioned above,this paper puts forward some suggestions to improve the compensation system of house expropriation in the reconstruction of villages in city from the aspects of expropriation procedure,Compensation Standard and value evaluation.
