Direct selling is of great value to individual,society and country,so it is necessary to develop direct selling industry.At present,China is opening up direct marketing in a planned way,and has promulgated a series of supporting laws and regulations,such as the direct marketing management regulations,to regulate the direct marketing industry,and the direct marketing market has begun to take shape.However,due to the imperfection of direct marketing license supervision system,direct marketing brings economic benefits to the society and causes many problems,so it is urgent to improve the direct marketing license supervision system.This paper focuses on the regulatory system of direct marketing license.Based on the review of the academic research on the regulatory system of administrative license,it analyzes the way and content of the regulation of administrative license on direct marketing market,and puts forward its own views on the system defects and unsolved problems,in order to provide suggestions for the healthy promotion and development of direct marketing market in China.First of all,it demonstrates the particularity and legitimacy of the direct marketing license.In terms of the current failure of the direct marketing market,the regulatory norms of the direct marketing license and the regulatory practice,the establishment of the license for the main body of the direct marketing market conforms to the provisions of the Administrative License Law,the principle of proportion,and the regulatory legitimacy.Secondly,it analyzes the problems in the regulation from the stage of direct marketing permission.The administrative organ supervises the access through deposit,paid in registered capital and two-level examination and approval system,but it sets too high access conditions for direct marketing market for the purpose of supervision,which limits the development of direct marketing industry and excludes many small and medium-sized enterprises originally operated by direct marketing from the scope of supervision and approval.At the same time,the vagueness of licensing standard and the lack of the system of administrative licensing explanation In fact,it damages thelegitimate rights of the license applicants.Thirdly,from the perspective of the follow-up supervision stage of direct marketing license,there are some problems,such as the lack of legitimacy of the regulatory body,the unclear division of regulatory authority due to multiple supervision,the imperfect communication and coordination mechanism,the vague regulation of regulatory procedures,and the lack of responsibility of the administrative body.Finally,based on the analysis of the above problems and the reference of foreign experience,some suggestions are put forward to solve the existing problems.This paper holds that the government should change the regulatory thinking of the direct marketing license system in time,take promoting the development of the direct marketing industry as the guiding ideology,moderately relax the market access conditions,support and guide the development of the direct marketing industry,determine the direct marketing license standard and establish the administrative license explanation system,and limit the discretion of the licensing authority;in addition,it should improve the subsequent regulatory laws and regulations,Through the timely revision of the regulations,the legitimacy of the regulatory body is clarified,the communication and coordination mechanism between regulatory authorities is established,the regulatory procedures are refined,and the legal responsibilities of administrative organs are implemented.Through the improvement of the direct marketing license supervision system,this system can play a better role and really become the way to maintain the rational order of the direct marketing market.
