Legal Thinking On The Marriage And Family Relationship Of Mosuo People

The marriage and family relationship of ethnic minorities is an important part of their social life,and also an important embodiment of their cultural development.The Mosuo people in Yongning,who live in the border of Sichuan and Yunnan,still have a unique marriage and family relationship.They take matrilineal blood as a link,and form a matrilineal family of "uncle in charge of etiquette,mother in charge of power",emphasizing women but not men,unity and harmony.In terms of marriage,they choose the form of walking marriage in which men and women do not marry and women do not marry.Both men and women can freely choose the object of walking marriage,and combine it in the form of "closing in the evening and leaving in the morning" to realize the connotation of marriage by "walking".This kind of marriage is a combination of voluntariness and freedom of separation,which is called "living fossil of human marriage" by many scholars.The Mosuo people in Yongning have a set of their own ethics and moral standards for the maintenance of their children,the support of the elderly,the distribution and inheritance of their property,so as to ensure the harmony,order and close unity within the family.Taking Mosuo people in Yongning District of Ninglang County,Lijiang City,Yunnan Province as an example,this paper takes Mosuo people’s walk marriage and matrilineal family relations as the research object.The main content of the study is divided into five parts: the first part mainly summarizes the evolution of the marriage and family relationship of the Mosuo people in Yongning,including the causes of the marriage and family relationship of the Mosuo people in Yongning,as well as the impact and development trend of the marriage and family relationship in the long-term historical development process;the second part describes the basic content of the marriage and family relationship of the Mosuo people in Yongning,including the way of going The third part,from the legal point of view,defines the nature of the marriage and family relationship of the Mosuo people in Yongning as the customary law,and on this basis summarizes the main sources of the formationof the customary law;the fourth part,from the aspects of personal relationship,property relationship,women’s rights,family dispute resolution mechanism,etc In the fifth part,the author thinks about the value of the existing marriage and family customary law of the Mosuo people in Yongning and the practical basis of the interaction between the customary law and the current legislation of our country.Finally,the author discusses the ways and means of the interaction between the customary law and the national legislation.In order to build a unified society under the rule of law,we hope to provide some useful references for the good adjustment of the marriage and Family Customs of Mosuo people in Yongning and the current national laws in the field of marriage and family.
