Economic development and technological progress have brought about changes in the way of production organization and employment.The development of artificial intelligence has led to continuous innovation in the form of employment.The rise and rapid expansion of flexible employment have led to new changes in the field of labor.Monopoly capital and atomized labor form coexist,a large number of man-machine collaborative labor emerge,and the strength of workers is weakened.Artificial intelligence shows the characteristics of "machine replacement",which makes "technical unemployment" become a hot topic again.Due to the change of labor factors and the weakening of "subordination" of workers to employers,labor relations have also changed.Standardized labor relations and non standardized labor relations coexist,which brings impact and challenge to the traditional labor law system.Because of the limitation of the scope of labor standard,the difficulty in the practice of collective negotiation system and the lag and deficiency of labor contract law,the protection of workers’ rights and interests is faced with risks.This paper discusses the new characteristics and causes of the labor field under the development of artificial intelligence,and analyzes the shortcomings of the current labor rights protection system with the economic method.It holds that the risk of the current system lies in the imbalance of the supply and demand of the laws related to the labor rights protection and the high system cost.Both labor and capital have incentives to avoid costs and obtain greater benefits.The legal system used by the government to regulate labor relations lags behind and lacks,which makes the system operation difficult to achieve efficiency balance.In the face of the new economic development situation and the new changes in the labor field,it is necessary to reconstruct the protection system for the rights and interests of workers,reduce the operating cost of the system,match the supply and demand of the law,and balance the interests of the main bodies of the labor market.At the same time,we should also pay attention to the infringement of artificial intelligence technology on workers,improve the ability to protect technological risks,and let enterprises maintain the power of technological innovation and application within the framework of legal regulations.Only through the reform of the labor legal system to promote the behavior incentive of the main body of labor relations,can enterprises have incentive to provide labor protection,workers have the right to demand incentive,and the government has incentive to regulate the risk of labor relations,so as to achieve the balance of interests of the main body,alleviate the contradiction between labor and capital,and let the protection system of workers’ rights and interests take into account fairness,justice and efficiency.
