Research On The Legal Issues Of Asset Recovery Of Corruption Crimes In China

In recent years,the corruption crime in our country is very serious,the state has taken it as the focus of work.China has also successively carried out "fox hunting" and "skynet" operations to recover some assets,but there are still a large number of assets abroad can not be recovered.Fundamentally,China has not established a complete and feasible mechanism of recovery.There are many obstacles to the recovery mechanism.This paper studies China’s recovery mechanism through the following four chapters:The first chapter is the overview of the corrupt criminal assets and the way of our country’s recovery.Firstly,it briefly expounds the corruption crime and the assets of corruption crime and its definition.Then it analyzes five ways to recover corrupt assets in China.The second chapter analyzes the legal obstacles to the recovery of overseas assets in China.Firstly,the obstacles of the five recovery methods mentioned in the previous chapter are analyzed,and then the causes are analyzed from the aspects of international law and domestic law.The third chapter is China’s reference to foreign assets recovery.This paper introduces the asset recovery system of typical countries in common law system and civil law system.In particular,the independent civil confiscation system of AngloAmerican law system is introduced.The fourth chapter is the perfect suggestion for our country overseas to recover the assets.First is to improve the domestic legislative and judicial system,then to build a sound asset sharing system,and finally to improve the way of work and operational barriers.
