The Chinese functional food industry emerged in the 1980 s,since entering the21 st century is witnessing continuing vigorous development trend.With the transformation of the principal contradiction in our society,people from the initial pursuit of full meals to pay attention to food health and its effects,not only to eat full,but also to eat well.At the same time,the country gradually attaches great importance to the functional food industry development,implement the strategy of health in China is more powerful symbol.In recent years,functional food is more and more favored by consumers,the development of functional food industry has shown a thriving situation.However,accompanied by the functional food industry rapid development,functional food market,a mess of counterfeit and shoddy functional food emerge in endlessly,the phenomenon such as false advertising,seriously damage the legitimate rights and interests of consumers,functional food safety issues highlighted.The basic route of the rule of law is to resolve functional food safety problems.The food safety law of the People’s Republic of China(hereinafter referred to as the "food safety law")clearly stipulates that China’s functional food shall be strictly managed,and stipulates such contents as market access,raw material list and functional claim of functional food.The life of the law lies in the implementation,implementation,refinement,and improvement of the functional food regulatory legal system,to protect the safety and security of consumers purchasing products,and to promote the healthy development of the functional food industry,which has become an important task in front of the theoretical and practical departments.Focusing on the legal system of functional food supervision,this paper has carried out the following research work: first,define the concept of functional food,clarify the connection and difference between functional food and food,analyze the particularity of functional food supervision compared with food supervision,analyze the legal basis of functional food supervision,and provide legal support for the further study of the current situation of the legal system of functional food supervision in China.Secondly,on the basis of elaborating the development process of the legal system of functional food supervision,this paper analyzes the current situation of the legal system of functional food supervision in China,and points out that the main problems in functional food supervision in China are that the legal norms of functional food still need to be improved,the supervision of functional departments at the grass-roots level is difficult,and the system of functional food supervision still needs to be implemented.Thirdly,by comparing the practice of functional food supervision in some countries,such as the United States and Japan,the author starts from the legislative situation and regulatory measures,and concludes the experience that can be used for reference to further improve the legal system of functional food supervision in China.Finally,based on the above research,this paper puts forward some suggestions to improve the legal system of functional food supervision in China from the aspects of perfecting the legal norms of functional food supervision,perfecting the measures of functional food supervision,strengthening the responsibility of the main body of supervision and exerting the power of social co-governance.
