The Empirical Research On Fraud Of "Campus Loan"

In recent years,campus loans have caused a lot of tragedies,most of which involve serious fraud.In this regard,the media is widely concerned,the government attaches great importance to.From the empirical cases studied in judicial practice,"campus loan" fraud has the general characteristics of fraud cases,which should be adjusted by the relevant provisions of the Criminal Law on the crime of fraud.But at the same time,it has its particularity.As the subject of victimization,special protection should be considered in the regulation.Therefore,there is still room for system review in the prevention and regulation of fraud in Campus loan.With regard to the regulation of "campus loan" fraud,we can draw lessons from the provisions on halving the amount of punishment issued by the Supreme people's Court and the Supreme people's Procuratorate in 2013 on some issues relating to the applicable laws governing the handling of criminal cases of theft.The conviction amount of "campus loan" fraud case should be reduced by 50%.For the student group,the amount of "campus loan" fraud,which reaches half of the amount of ordinary fraud case,constitutes the standard of "large amount".Secondly,considering the influence of the crime circumstances on the conviction,increase the small number of cases into the penalty;third,increase the punitive economic compensation system,in order to increase the criminal cost of "campus loan" fraud.
