On The Construction Of Big Data Property Right Protection System

In the era of digital economy,the deep integration of Internet,artificial intelligence,big data and industrial economy,the advancement of science and technology has caused information to explode and accumulate into an astonishing number of data resources.At the same time,products and industrial chains with data services came into being.The use of data is not only a part of the national lifestyle,but also a business model and an essential production factor.However,due to the lack of and lack of data rights arrangements in the current law,it has seriously affected the normal circulation of data resources in the market,and has also led to the abuse or infringement of related rights without legal protection.Therefore,it is urgent to construct a data property protection system.Based on this,this paper explores the following issues in the construction of data property protection system under the era of big data:First of all,this paper reveals the types and characteristics of big data by discriminating the concept and basic properties of data and big data,and draws out the characteristics of the rights subject,the theoretical basis,and other rights that should be considered when constructing data property rights.The relevance of the subject;secondly,to explore the corresponding theory and basic principles of property rights construction,which lays a solid foundation for the construction of a rights system;again,analyzes and drawson the protection model of similar rights outside the domain and related legislative practices.The rationality and adaptability are discussed.Finally,based on China’s national conditions and the Internet environment,the content and restrictions of data property rights are studied in detail,and their links with some domestic laws are discussed.
