The Research Of Infringement Risk And Countermeasures Of Patent Of Enterprise For Industry Chain

The rapid development of technological innovation and the accumulation of innovative high-tech industries have led us into the modern information age.As innovative products and services change intrinsically,technology-intensive industries such as semiconductors,information technology,communications,pharmaceuticals,and biotechnology use patents to protect their inventions.In the complex high-tech industry,more and more companies are applying for patents for strategic reasons,resulting in a surge in the number of patent applications.The increase in the workload of patent offices and the increased search costs of prior art led to the emergence of more patented overlapping patents and smaller inventions that were granted more patents.Because there are many related patents with uncertain claims,companies that mass produce and sell complex technology products are often unable to effectively ensure that their products do not infringe the patents of another company.As a result,the patent thicket phenomenon has emerged in high-tech intensive industries with a large number of patents with complex and modular technologies.With the strengthening of global economic integration and intellectual property protection awareness,it is of great significance to study the patent thicket problem in depth.This paper studies and analyzes the risk management scheme of patent infringement in the industrial chain.Based on the rational construction of the industrial chain and the industrial technology chain,the lda2 vec theme model is used to analyze the patents in the technical field,obtain the technical sub-themes,and map the patents to the industrial chain.In different aspects,the patent data sets of various technical fields are obtained,and the social network analysis method and the text similarity method are used to measure and identify the patent thicket outside the industrial chain and the industrial chain respectively,and analyze the characteristics of the patent thicket,and the patent thicket risk assessment,analysis of the causes of patent infringement risk,and finally proposed strategies and recommendations for companies to reduce or avoid patent thicket problems by cross-licensing,package licensing,and establishing patent pools.From the perspective of industrial chain,this paper combines data mining,social network analysis and other methods to measure,identify and evaluate patent infringement risk.Based on foreign studys to deal with patent thicket,this paper proposes a suitable patent infringement risk for the development of China's welding robot industry.It is suggested that it has certain reference significance for enterprise alliances,mergers and acquisitions,and avoiding obstacles and hold-up.It has important guiding significance for enterprises to successfully implement free management through patent thicket.
