Study On Legal System Construction In The Early Stage Of New China

Although the system construction does not produce direct economic benefits,it has played a role of escorting a country's social stability,labor production and the operation of state power.In the early days of the founding of New China,the Communist Party of China led a series of legal construction work and made remarkable achievements.At present,our country is building a society ruled by law.Studying and discussing a series of legal construction work carried out by the Communist Party of China in the early days of the founding of New China is not only conducive to the implementation of the concept of governing the country by law,but also to the construction and development of our country ruled by law.This paper is divided into three parts.The first part of the article briefly states the concepts of legal system and rule of law.At the same time,it elaborates in detail the pressures of economy,people's livelihood,military affairs,social stability and other aspects faced by our country in the early days of the founding of New China,and the tasks of legal system construction in this period.At the early stage of the founding of New China,the legal system construction had a certain theoretical and practical basis.Marx's legal system thought,Lenin's legal system thought,Mao Zedong's legal system thought and China's excellent legal culture constituted its theoretical basis.The practice of legal system construction in the base areas of the New Democratic Revolution and the legal system of the Soviet Union constituted the practical basis.The second part of the article introduces the main content of legal system construction.On the basis of the Common Programme and the May 4th Constitution,China has promulgated legal provisions concerning criminal,civil,social security and economic development to regulate all social relations.In accordance with the provisions of the May 4th Constitution and the Organic Law of the People's Republic of China,we have established a new judicial system,procuratorial system and judicial administration system,as well as a complete set of judicial administrative organs.The third part of the article elaborates the historical contribution and contemporary thinking of the legal system construction in the early period of the founding of New China.In the early years of the founding of New China,the construction of the legal system established the basic system of our country and orderly promoted the judicial activities.In order to realize the grand goal of rule of law in China as soon as possible,we should adhere to the organic unity of the leadership of the Party,the people as the masters of the country and the rule of law,comprehensively deepen the reform of the system and strengthen the implementation of the Constitution.
