Research On The Cognizance Of Special Drug Trafficking

In our country,drug-related crimes occur frequently and are prohibited repeatedly.The types,modes and forms of crimes are diversified and complicated,and even have the characteristics of regionalization,scale and industrialization.The most common type of drug-related crimes is the crime of drug trafficking,and the crime of drug trafficking has become the most difficult type of crime in the fight against drug-related crimes.With the spread of drug-related crimes,the Supreme People's Court,the Supreme People's Procuratorate and the public security organs jointly issued a series of laws,regulations and normative documents to regulate drug-related crimes.The promulgation and implementation of these laws and regulations and normative documents provide a certain legal guide for drug crime control in theory and practice.However,from the point of view of jurisprudence,the theoretical expression of the existing laws on the related issues of drug trafficking crime is not strict and clear,and there are still many disputes and differences in the application of the law.This paper will try to discuss the identification of special drug trafficking from four chapters,especially the definition of drug trafficking,the identification of drug trafficking in intermediaries,the identification of drug purchase on behalf of others,drug reciprocity and the identification of drug donation.In judicial practice and theoretical circles,there are still some disputes on the above issues,which to some extent affects the identification of the crime of drug trafficking.Based on the relevant theoretical basis of criminal law hermeneutics,and in full consideration of the current severe situation and problems in judicial practice,this paper makes a comprehensive study and analysis of some controversial issues in the special drug trafficking.Finally,the author hopes that the research and analysis of this paper can effectively solve the drug crime problems in judicial practice and contribute to the punishment of drug crime in China.
