A Study On The Practical Issues Of National Self-determination

As an important basic principle of international law,the connotation and application conditions of the right to national self-determination have changed greatly.After the 1990 s,this principle was overused,posing a great challenge to the current international order.However,international law has not specified the application of the right to national self-determination,and it is difficult for scholars from various countries to reach a unified conclusion,which makes the application of the right to national self-determination face many difficulties and challenges.With the development of The Times,the right of national self-determination has been endowed with many new connotations,but this will also lead to the right of national self-determination becoming a tool for some ethnic separatists to seek independence.Moreover,it is observed that in modern times,some regions seeking to establish independent sovereign states have more or less abused the right to national self-determination,which poses a serious threat to national sovereignty and territorial integrity and the stability of the international community.Therefore,it is a difficult problem for the whole world to clarify the contemporary meaning of the right of national self-determination,study the applicable dilemma of the right of national self-determination and find the way to solve the problem.It is of great significance to study the application of the right to national self-determination.The main body of this paper consists of four parts.The first part introduces the concept,content and development of the right to national self-determination.The second part analyzes in detail the applicationdilemma of the right of national self-determination in the application process through the provisions of international law and practical cases,and then analyzes the causes of this dilemma.These include the contradictions between the principle of state sovereignty and the application of the right to national self-determination,the intervention of various forces of the international community,the ambiguity of the provisions of the applicable subject,the imperfect application method,and the confusion of the right to national self-determination caused by national separatism.In the third part,through my own thinking and understanding,I put forward some normative Suggestions to improve the national self-determination.First,the application conditions of the right to national self-determination are limited,including the application premise,the application subject and the application method.Second,improve the application method.Standardize and improve the referendum to ensure its legitimacy and effectiveness.Analysis of the use of force in the manner of the prohibition of the use of force principle.Thirdly,the concept of self-determination,independence and separation is analyzed,and the relief separation is discussed to further distinguish the right of national self-determination and national separatism.Fourth,the role of international organizations should be brought into play to restrict and promote the application of the right to national self-determination.Fifth,the establishment of a new international order through enhanced exchanges and development among states.In view of the dilemma in the application of the right to national self-determination,we should improve it so as to make it better applied and developed.In the fourth part,the author puts forward some Suggestions on how to prevent the abuse of the right of national self-determination for ethnic separation based on the actual situation of China.
