Study On The Governance Of Rural Illegal Construction In Suburbs Countryside Under The Background Of Urbanization

In order to implement the spirit of the 19 th National Congress of the Communist Party of China(CPC)and the strategy of rural revitalization,the general office of the CPC Central Committee and the general office of the State Council issued “Guiding Opinions on Strengthening and Improving Rural Governance” in June 2019.This measure reflects the importance of strengthening and improving rural governance at this stage.The suburban rural areas exists as a transition period between urban and rural areas.Due to the nature of the land,administrative structure,management system,etc.,the governance of suburban rural areas still belongs to the category of rural governance.With the continuous progress of urbanization,governance in the suburban rural areas are more complex than the rural areas far from city.The illegal construction management is not only concerned by the villagers,because of it is closely related to their interests,which is easy to breed contradictions,but also played an important role in the long-term development of rural areas and surrounding cities.Therefore,it is an important part of suburban rural governance.In order to rationalize the construction order,reduce the contradiction rate,and ensure the smooth progress of urbanization,all regions have taken different innovative measures in practice in order to achieve the effective purpose of the suburban rural illegal construction management.This paper takes the C Street in Wuhan as an example to study the current situation and difficulties of the construction management in the suburban rural areas.It has certain theoretical value and practical significance to study the rural construction management measures in the suburban rural areas from the perspective of "Three Governance Integration" by drawing lessons from the experience of various regions.Based on the theory of public management and the theory of good governance,this paper makes a systematic study on the governance of suburban rural illegal construction through the combination of literature research and case investigation.Firstly,by collects and sortis out relevant laws and regulations,domestic and foreignresearch results and relevant basic theories,this paper expounds the basic concepts of urbanization,suburban rural areas and illegal construction,and points out that suburban rural areas still retain the autonomous management system of rural characteristics,but it is also affected by urban management,and summarizes the construction behaviors mainly included in "illegal construction".Then,through the analysis of the governance of the C Street in Wuhan since 2017,this paper analyzes the causes of illegal construction in suburban rural areas,summarize the experience and practice of illegal construction management,and points out the dilemma of illegal construction management.Base on the experience of other regions,this paper proposes countermeasures and suggestions for illegal construction management in suburban rural areas from four aspects: 1.Through building a strong Party organization,giving full play to the vanguard and exemplary role of Party members,making good use of the party organization platform,and giving full play to the leading role of grass-roots party organizations in the governance of violations;2.Starting from propaganda,we should stimulate the initiative of villagers’ self-government,participate in the governance of illegal construction,strengthen the construction of self-government organizations,assist villagers to carry out self-government,encourage the participation of social organizations,provide help and relief channels for villagers’ self-government,integrate the forces of villagers’ self-government,local self-government organizations and urban social organizations;3.Improve the efficiency of law enforcement procedures by complete the legal system of illegal construction governance,increase punishment,enrich punishment measures,increase the cost of illegal construction,improve law enforcement procedures;4.Play the role of Moral Governance by mining positive and negative examples,supporting local activities,enriching propaganda methods,and improving village rules and regulations.It is hoped that through the above suggestions,ideas will be provided for the harmonious and efficient rectification of rural construction order,the maintenance of rural village appearance,the protection of people’s human rights,and ultimately guarantee the orderly development of suburban rural areas and the smooth promotion ofhigh-quality development of new urbanization.
