Research On Chinese Lawyers' Disciplinary Power

Establishing a high-quality lawyer team is an important part of China's training of high-quality rule of law talents.Lawyers must fully play their unique role in the construction of socialist rule of law,and must have an effective management system.An effective lawyer management system is not only the need to maintain the credibility of lawyers and the sustainable development of the industry,but also the performance of comprehensively governing the country according to law.At present,the disciplinary system of lawyers in the theoretical and practical circles has not yet completely unified standards.This paper studies the related issues of the disciplinary system in the lawyer industry,mainly from the combination of theory and practice,compares the current situation of Chinese and foreign laws and the analysis of the current situation of the disciplinary system of the lawyer industry in China,finds the problem and analyzes it at the same time,and finally puts forward some problems based on China's national conditions.Suggestions for improving the disciplinary system of the lawyer industry in China.Establishing and perfecting the lawyer's disciplinary system in line with China should be based on China's basic national conditions.The lawyer management system under the leadership of the judicial administrative organs should be linked with the lawyers association for a long time.As a self-disciplined institution,the Lawyers Industry Association has unique advantages,and at the same time,it can play its self-discipline supervision role with its professional advantages.Judicial administration should play a leading role in the implementation of the lawyer's disciplinary system.The construction of the disciplinary system for socialist lawyers with Chinese characteristics is: first,to clarify the subject of lawyers' disciplinary action;second,to set up a reasonable disciplinary organization;third,to strengthen the self-discipline management ability of the lawyers' association;fourth,to redefine the types of disciplinary administration;The fifth is to improve the review mechanism of the lawyers association's punishment lawyers.
