The full text is divided into four chapters.The first chapter is the Arctic channel and its location.The second chapter is the Arctic waterway marine environmental protection governance legal policy and the UNCLOS.The third chapter is Canada,Russia’s Arctic Waterway Environmental Protection Law and International Code for Ships Operating in Polar Waters.Through the overall analysis of the four chapters,the following analysis results will be finally obtained: First,the legal status of the Arctic waterway in the future is likely to form a large-scale navigation of the NSR and the Northwest Passage.The international community is still in dispute.The nature is not conclusive.When the sovereignty seeks to seek jurisdiction over the waters of the Arctic waterway,the Arctic countries represented by Canada begin to highlight the special environmental protection appeals of polar waters,hoping to promote the domestic polar regions through the “low political” appeal of environmental protection.The water environment environmental protection legislation and policies,as well as the update of international rules and the realization of its jurisdiction over the Arctic waterways related waters,Canada has achieved good results,which is marked by its domestic Arctic Water Pollution Prevention and Control Law system.The construction and implementation of the “Ice Zone Terms”;secondly,the current legislation and policy implementation of environmental protection in Arctic waters in Canada and Russia still may break through the “appropriate care of navigation” and“the most reliable” of Article 234 of the Convention.Scientific evidence-based"Therefore,it may violate the principle of freedom of international navigation.In the future,it is necessary to absorb the contents and operational modes of polar rules and promote the internationalization of waters.Third,countries outside the Arctic,represented by China,should seize the opportunity that the Arctic waterway management order has not yet fully formed.The interest in the passage of the Arctic waterway.In the face of the concept of marine environmental protection,which should be respected by all mankind and the international community,China should respect the reasonable environmental protection demands of Canada and Russia for the waters related to the Arctic waterway,and the Arctic Council and other Arctic countries such as Canada and Russia.We will carry out a good cooperation mechanism between countries to jointly safeguard the environmental safety of the Arctic waterways,and actively carry out dialogues and exchanges to carry out infrastructure construction along the Arctic waterway and rational development and utilization of resources.At the same time,in the future trend of internationalization of the Arctic waterway,as a flag State,China should fulfill its obligations under the UNCLOS regarding the implementation of internationally accepted standards for the prevention of marine pollution by flag States and in accordance with the Polar Rules.Operational requirements for ship design,construction,staffing,environmental protection,and pollution prevention.Only the countries and flag states of the Arctic waterway can abide by the international conventions and rules related to polar waters in order to achieve good maintenance and development of the interests of all parties.
