A Study On The Legal Guarantee For The Rejuvenation Of Ethnic Villages

Rural Revitalization Strategy,as a major strategic decision to solve the "three rural" problems,has brought new opportunities for the overall political,economic,cultural,social and ecological development of ethnic villages.The improvement of rural revitalization system supply is an important guarantee for the further promotion of rural revitalization strategy,and also puts forward new development requirements for the construction of legal system in ethnic villages.The particularity of the purpose and nature of the system of national villages determines that they have special needs for the institutional guarantee of rural revitalization compared with the general villages,it should be considered from the general system demand and the special system demand.Based on the system demand of national rural revitalization,this paper points out the gap and deficiency between supply and demand by combing the current situation of legal guarantee of national rural revitalization.On the basis of seeking the theoretical logic for the legal system supply of the revitalization of the ethnic villages,and then from the aspects of clarifying the autonomous power of the ethnic villages,from the construction of the legal system of the revitalization of the ethnic villages and the perfection of the legal system of the ethnic villages and towns,some suggestions are put forward to improve the system guarantee of the revitalization of ethnic villages.The full text consists of introduction,conclusion and four chapters.The first chapter explains the essence and connotation of ethnic rural revitalization according to the target of rural revitalization,analyzes the particularity of ethnic rural revitalization through the research on the structure and nature of ethnic townships,and then discusses the general system and special system needs of ethnic rural revitalization.Because of the special nature of the ethnic villages,such as the purpose of the establishment,nationality,autonomy and culture,the connotation of the ethnic villages is richer and the demand is more unique.The second chapter combs the present situation of the current legal system,the rural revitalization system and the special system of the national rural revitalization from many levels,many angles and many levels through the normative analysis,and pointed out the existing system than the national rural revitalization of the institutional needs of the deficiencies.In the current legal system,the regulations on administrative work in ethnic townships and the Local ordinance and regulations are still the main normative basis for the work in ethnic villages.In the rural revitalization system and the national rural revitalization of the special system level,the country and various regions have carried out a useful system try,but is still in the initial stage.The legal system is not perfect,the legal system construction is weak,the legislation characteristic insufficiency is obstructs the national village revitalization system safeguard the bottleneck.The third chapter analyzes the meaning of the theory of system supply,the theory of national equality,and the theory of co-construction,co-governance and sharing to seek the theoretical and logical basis for the guarantee of national law for the revitalization of nationality townships.Chapter Four,on the basis of clarifying the autonomous jurisdiction of ethnic townships,it is proposed that efforts should be made to perfect the legal system of ethnic villages,perfect the system of rural revitalization and the special system of rural revitalization of ethnic villages,restore the organizational system of Ethnic towns of the People's Republic of China,establish and perfect the system of villager autonomy of ethnic villages,etc.,to provide institutional guarantee for the revitalization of ethnic villages.
