A Study On The Filing Of Criminal Cases In Public Security Organs

The Fourth Plenary Session of the 18 th Central Committee of the Communist Party of China proposed to comprehensively promote the rule of law.In the report of the 19 th National Congress of the Communist Party of China,the rule of law has been raised to an unprecedented level.The status and role of the rule of law in the current overall work of the party and the country are becoming more and more prominent.As a law enforcement agency,the public security organ must strictly and justly enforce the law,especially in the process of handling criminal cases,criminal filing is the source of criminal proceedings,whose role and significance are particularly important in the initial link.In recent years,the strong law enforcement problems reflected by the masses also occur in the link of receiving and handling police and criminal case filing.After receiving the public alarm,the public security police have some problems,such as not accepting the case,not investigating the case,and not deciding for a long time,which make the people are dissatisfied with the public security police,which seriously damages the image of the public security agencyin law enforcement for the people,and hinders the harmony produces between the police and the people and impedes public trust in law enforcement Serious impact.Therefore,this paper focuses on the initial link of the public security agency in handling criminal cases-the case filing stage,analyzes the problems and causes of the problems in the criminal case filing of the public security agency,and tries to reduce the ineffective factors in the case filing at the source,so as to provide theoretical and practical enlightenment for the law enforcement operation of the relevant departments.In this paper,through the definition of the relevant concepts of the criminal case filing of the public security organs,based on the theory of procedural justice as the main analysis basis,the public security organs of City C as the specific analysis object,analysis of the problems exposed in the whole process of criminal case filing,and on this basis,analysis of the reasons deeply,so as to try to build a multidimensional control system to regulate criminal case filing.This paper finds that: the public security agency of our country adopt procedural start-up mode in criminal filing,and the supervision and control can not cover the whole process of criminal filing due to the multi-source acceptance of cases.In the receiving and handling link at the source of the case,the normal receiving and handling work is disturbed because of the huge invalid alarm situation.The judgment of the receiving and handling staff on the scope and type of the alarm situation is not professional,which leads to the contradiction between the receiving and handling police.The lack of professional ability of the handling police on the spot and on-the-spot situation leads to the influence of the early handling work on the collection and fixation of evidence in the early stage of the criminal case In the filing link of the source of criminal cases,because of the imperfection of relevant laws and regulations in the objective aspect and the deficiency of their own law enforcement and case handling ability in the subjective aspect,the law enforcement and case handling police have the prominent problems of not accepting,not accepting and not investigating cases.Based on the analysis of the management system of laws and regulations related to criminal case filing,the reasons of the police’s own business ability,legal thinking consciousness,supervision and control in each law enforcement link,combined with the relevant work of the public security organ in City C in the criminal case filing link,this paper puts forward a professional way to realize the unified centralized management of criminal case filing and improve the ability of law enforcement stuffs from the aspect of perfecting the system,the consciousness of rule of law and the ability to solve the problems in the process of criminal case filing,which will strengthen supervision and control,and build a diversified procedural control mode to explore the perfect path of criminal case filing.
