Research On The System Of Review Requirements In Legislative Law

In China’s constitutional review mechanism,the system of requests for review made by state statutory organs is called the system of requests for review.It should be the most effective part of the mechanism for the record review of the NPC Standing Committee,but it has become the "shortest board" in the operation of the system.In the case of requests for review made by the five statutory organs,the principle of requests for review put forward by state organs has not been in charge since the implementation of the legislative law.He reports and records.In order to explore the scheme of activating the mechanism of legal subject’s request for review,this paper relies on Article 99 of the Legislative Law to analyze the content,significance and value of the review system,and differentiates it from other review systems in China.Through the analysis of the nature and function of the five legal organs,this paper analyses the shortcomings of the subject of review and the procedure of acceptance,and draws lessons from Anglo-American law.The department and the continental law system represent the beneficial experience in the establishment and practice of the legal starting subject of the relevant system of the state,put forward the relevant opinions and suggestions to improve the system,endow the deputies of the National People’s Congress with the power to start the constitutional review requirements and design the relevant system,put forward the idea of linking the system of incidental judicial review with the system of review requirements,and advance the idea of perfecting the review procedure.Step description.It is hoped that the discussion in this paper can provide suggestions for the further improvement of China’s review request mechanism.
