On On The Legislative Perfection Of The Demonstration And Consultation On The Adjustment Of Major Interests In The Formulation Of Administrative Regulations

The formulation of administrative regulations is a professional and scientific work,and the interests involved in the formulation of administrative regulations are often complex.The fourth plenary session of the 18 th central committee of the communist party of China(CPC)proposed to establish argumentation and consultation on the adjustment of major interests in legislation,so as to promote scientific,democratic and law-based legislation,give full play to the role of social forces in legislation,and further improve the quality of legislation.The formulation of administrative regulations is an important part of China's legislative work.At present,the academic research on the argumentation and consultation concerning major interest adjustment in legislation mainly discusses the concept,scope,value and shortcomings of argumentation and consultation concerning major interest adjustment.This paper focuses on the legislative perfection of the demonstration and consultation on the adjustment of major interests in the formulation of administrative regulations.Firstly,the concept,features and functions of the argumentation and consultation on the adjustment of major interests in the formulation of administrative regulations are explained.Secondly,it explains the principle of argumentation and consultation of major interest adjustment in the formulation of administrative regulations and the necessity of perfecting the legislation of argumentation and consultation of major interest adjustment in the formulation of administrative regulations.Third,the legislative status quo of the demonstration and consultation on the adjustment of major interests in the formulation of administrative regulations is sorted out.This paper analyzes the problems existing in the scope,participants,procedures and supervision of the argumentation and consultation on the adjustment of major interests in the formulation of administrative regulations.Finally,from the elaboration of the scope of the argumentation and consultation of the major interests adjustment in the formulation of administrative regulations,the participants in the argumentation and consultation of the major interests adjustment are clarified,the procedure of argumentation and consultation of the major interests adjustment is established,and the supervision of the argumentation and consultation of the major interests adjustment is improved.The countermeasures and Suggestions are put forward to improve the legislation of demonstration and consultation of major interests adjustment in the formulation of administrative regulations.
