Judicial Practice Analysis Of Damage Compensation In Consumer Civil Public Interest Litigation

Consumption civil public interest litigation is an important means of protecting the public interest in the consumer field.The damages of its remedy channels can not only deter illegal operators,but also compensate the damaged consumers and maintain social public welfare.The development of consumer civil public interest litigation in China started late,and the lack of detailed provisions on compensation for damages in consumer civil public interest litigation in the legal regulations has not been able to meet the current demand for the proliferation of public interest litigation in the consumer field.In judicial practice,there is a big controversy as to whether consumer civil public interest litigation should support claims for damages.The article is divided into four chapters.The first chapter is the introduction of the problem.Taking the judicial practice of damages compensation as the center,through the enumeration of judicial practice cases of consumer damages in civil public interest litigation and comparative analysis,it leads to the thinking of damage compensation in consumer civil lawsuits.The second chapter is an overview of damage compensation for consumer civil public interest litigation in China.Based on the basic theory of consumer civil public interest litigation,the necessity of the current compensation of consumer civil public interest litigation in judicial practice is put forward.The third chapter is about the problems existing in the judicial practice of China ’s consumer civil public interest litigation damage compensation.Through the analysis of the case and the theoretical research,it is found that China ’s consumer civil public interest litigation damages compensation system is in terms of the requesting body,applicable standards,and use management.Need to be perfected.The fourth chapter is the construction of China’s consumer civil public interest litigation damage compensation system.According to its problems in judicial practice,it has established a system from the improvement of the litigation subject in the legal provisions to the calculation of compensation to the use management.The complete consumer civil public interest litigation damage compensation system from the submission of damage compensation to the realization of damage compensation.
