Study On The Administrative Penalty Of Jiangxi Production Safety Under The Background Of Industrial Transfer

With the further promotion of the strategy of the great rise of central China,the economic phenomenon of industrial transfer has attracted more and more scholars' attention.Industrial transfer is an economic process in which some industries are transferred from one region or country to another after the resource supply or product demand conditions change.As one of the central provinces,jiangxi is backward in industrial development compared with the developed coastal provinces.However,with the transfer of a large number of labor-intensive industries from the Yangtze river delta and pearl river delta to jiangxi,the economic development of jiangxi has been injected with vigorous vitality,which is accompanied by the issue of production safety.Production safety is the basic premise of sustainable and healthy economic development,and production safety punishment is an important means to reduce illegal ACTS and accidents in production safety.The author through the literature on industrial transfer,safety production theory of punishment related concepts are analyzed to clarify the provides the theoretical basis for the article,by comparing other provinces punishment mechanism and basic production safety law enforcement problem feedback,found that finishing in jiangxi province safety in production problems to be solved in the administrative punishment,from the United States,Australia and mature foreign experience,to improve the safety in production in jiangxi punishment provide constructive Suggestions.This paper is mainly divided into five parts: the first chapter is the introduction,which mainly includes the research background and significance,related research overview,research ideas and methods,difficulties and innovations.The second chapter is an overview of administrative penalty of production safety,which mainly introduces the influence of industrial transfer on production safety in jiangxi province,the necessity of administrative penalty of production safety,relevant concepts,characteristics,special principles,factors and types of punishment.The third chapter is about the problems existing in the administrative punishment of production safety in jiangxi province.Firstly,through the comparison with the practice of production safety punishment in jiangsu and shandong provinces,the author finds that there are some problems in jiangxi province,such as insufficient prevention of punishment in advance and imperfect publicity of punishment information.Secondly,through interviews with grassroots law enforcement personnel of production safety,the authorsorted out the problems of selective law enforcement and the non-discrimination of administrative penalty objects.The fourth chapter introduces the experience of foreign production safety punishment,introduces the "enforceable commitment" system of Australia and the "negotiation and reconciliation" system of the United States,and summarizes the experience of these countries in considering various factors and flexibility of punishment means.Chapter v Suggestions on improving jiangxi administrative penalty system of production safety,aiming at the existing problems,puts forward Suggestions on improving jiangxi administrative penalty system of production safety under the industrial background.
